  1. I sent a letter to BH at the end of 2011 saying that I wanted to VT my agreement/car. The car was collected from outside my house after I left the keys under a bin. No paperwork was posted through my letterbox and I did not sign anything. A few weeks later BH wanted to take me to court to claim back the money they said I owed minus what they got for the car at auction. However, a week before the court case I was informed that BH had cancelled the case. I have heard nothing from them since? Does this mean they unlawfully got the car and I would be entitled to start a claim to get back any money I've paid?

  3. Posted the below on the Black Horse forums but haven't received a response and could do with some help urgently please! Received county court papers yesterday in relation to my Black Horse HP Agreement. My head is a bit of a mess so my first post will be probably be ramblings until I can work out what to do as I just don't know where to start. Took the agreement out in March 2009 for the following: Hire Purchase - £17,562.96 Insurance - £1,216.20 I have missed or been late with many payments pretty much since the beginning with charges calculating £1,408.51 which come under the headings Due Date Charge, 10 Day Collection Activity Charge Fee Charged, Late Payment Interest and LPI Adjustment. The court papers state that the unpaid balances are: Hire Purchase inc LPI and Fees - £13,008.30 Loan inc LPI - £920.96 The court papers also state the claimant will agree to the following amounts: Amount claimed as an alternative to delivery of goods - £13,929.26 Amount claimed in addition to delivery of goods - £5,060.79 I have the following questions to start with: * Is the Insurance stated on the Agreement but worded Loan on the Court papers actually PPI? * Can I claim back any of the charges and have this deducted from my total amount? * Where did they get the amount from for 'amount claimed in addition to delivery of goods'? I have a statement with all my charges and a copy of the agreement I was handed by the car dealer (minus my signature) and I have asked BH for a signed copy of the agreement but never received it. Am going to chase them up again for this now. I really hope someone can help me asap. My hearing is scheduled for 15th November but not sure how quickly I have to return my forms to them?! Please, please help . . .
  4. Oh and just spoke to the Legal Department for BH and they have just said that my 'Amount claimed in addition to delivery of goods' could increase if they get a lower price for my car at auction. Can they do this?

  6. Hi all, I bought my car on hire purchase in March 2009 through Black Horse. However, I am not 50% through my agreement as I am 8 payments in arrears. Next payment is due 01/09/2011. I no longer want the car as it is too small for my needs and is costing a fortune to run. I received a letter in August stating that 'This is a Notice of Default Sums and is given in compliance with the Consumer Credit Act 1974'. My questions are: 1. Does the above mean I have a Default Notice and cannot VT my car? 2. Am I able to hand it back and just make payments upto 50% 3. Can I send a recorded letter today stating that I want to VT and hand the car in to my local dealer tomorrow? 4. What do I actually need to write in the letter? 5. I have accrued about £1200 of charges, what can I claim back and how do I do this? 6. I asked for a copy of my agreement and account of charges and only received the latter. Is it a CCA to get copy of agreement? Think that is everything for now
  7. Hello, I took our car finance with Blackhorse in March 2009, since then I have missed 7 payments. I have always managed to come to an agreement with then. I received another default notice last week that says I have until 29th August to bring my arrears up to date. Basically, I no longer want this car. Can I hand it back? What paperwork do I need to ask for? I have accrued nearly £1000 of charges. Can I get any of these deducted?

Hello, I have been making my council tax payments as per my liability order and I paid what I thought were my last two council tax payments for this finiancial year back in December (Dec and Jan payments). However, last weekend my partner received an attachment of earnings order that has been sent directly to his work place. From the amount outstanding it would appear we were also meant to make payments in Feb and Mar. I thought we only made payments 10 out of the 12 months. My problem/query is that why haven't the council been in contact with us about the missing payments and about placing this order with his employer. Is there anything we can do about it?
  9. On Friday my rent was 13 days in arrears. I get home from work to discover that the landlord is in my property and has changed the locks on the front door and bolted the back gate. Just prior to this one of my neighbours calls the police because she has witnessed a man who she does not recognise in the property going through the drawers in the kitchen. The police attend and he explains that he is the landlord and carrying out maintenance work?! (I think changing the locks goes a bit beyond maintenance). I text him to say that he cannot legally do this and at the least I want my stuff. To which he replies that he has packed it all up and it's in the back garden. Sure enough he has packed up everything I own and put it into black binliners (even if it's not suitable for bags). This also includes going into my chest of drawers and removing my underwear, which gives me the creeps and I will be replacing. When I arrive my housemate is in the house with him pointing out what belongs to me and also helping him to pack the rest of my things. I am not allowed into the property. My deposit was also not paid into one of the schemes. I have had to leave all of my possessions at work and am staying at a friends house who lives 40 mins away from where I was living. I have taken pictures of my belongings being left in the garden and I have videos of him carrying my belongings out and putting them in the garden. So my question is, what can I do about this??
  10. Thank you for all your comments. I have tried to go to CAB, but where I live they only have drop in centres and I work full time so can't just hang around. It gets even better now we have a lounge and a dining room (currently only using this for storage). I have asked her to move her things out so I can use it as a lounge, she is refusing. Can you guess what I'll be doing at the weekend?! One things for sure I'll never be house sharing again!! Constant reassurance is always good, so please feel free to keep posting people
  11. Thank you for your comments. Unfortunately, she is beyond compromise. She just seems content to send me immature text messages. She has different men over several times a week (not for me to judge) and I have never said anything re this. I am constantly being told it's because she is jealous of my relationship. Anyway, all of that aside I am just struggling to get a definitive answer from anyone re whether or not she can do anything legally. Does anyone know?
  12. Hello, Right will start this post with explaining my living arrangements. I signed a 12 month contract in October with my friend for a 3 bed property. She has a 4yr old son. It was only mine and hers name put on the agreement. I agreed to let them have a room each and I'd have the 3rd but that we would still split the rent and all bills in half. We are now 5 months into the contract. I have recently got into a relationship and admittedly my boyfriend has been staying over 4 to 5 times a week. However, he never comes round until about 20:30 and is gone by lunch the next day and we always stay in my room. He doesn't contribute towards rent and bills but does buy the toilet rolls, cleaning products, milk, squash etc. I have read through my contract and it doesn't state anywhere re restrictions on having people stay over. I have today had a text from my housemate stating that she has got legal advice and my boyfriend is classed as living here and she doesn't want that so is going to take it further to stop it happening. Is she correct and can anything be done?

I appreciate this is normally used for people who can't afford to pay back their payday loans, but I really need to borrow some cash quick until payday, in which I will have overtime to pay back the loans. Will probably need to use 2 or 3 companies, can anyone reccomend seperate one's? Also, is it usual for them to ask for your sort code, account number and 3 digits on back of card? Any help greatly appreciated.
  15. Hello, I have recently signed a 12 month contract on a house, it was a contract bought from WH Smith. However, I am having massive problems with my housemate and her family and am wanting to leave. Am I stuck in the peoperty until the contract runs out or can I give a months notice to my landlord?
