Hi, I'm getting seriously ****ed off with the bank of scotland... 56 days saince their acknowledgement to my 1st letter requesting charges to be refunded. 2nd letter sent on 8th Jan with 2 weeks response period dictated by me. I'm being told that they have until 5th of Feb to respond to my case. My 1st letter dated 5th Dec, so they are adding 2 months but in actual fact adding 8 weeks means the 8 week deadline is in actual fact 31st Jan 07, i.e. TODAY. I wouldn't mind if they'd sent a correspondence weeks ago saying it would take 8 weeks to resolve this but I’ve had nothing, and I regard this as rude. I’m just wondering what is the interpretation of 8 weeks within the letter of the law, because if its my current interpretation then they’ve had their time. I’m quite happy to go to Court, although I’m not exactly relishing the thought, I’ve studied the notes within the forums for Bringing Case to Court. Do you think I should phone them tomorrow saying that the 8 weeks are up, and would this kind of treatment give me any additional clout in court? Many Thanks...
  2. Hi, Its now been 76 days since my initial request for my charges to be refunded on one of my accounts. I never received a reply to my 1st letter so I issued them with a 2nd letter giving them 2 weeks to reply before court action, its been 14 days since i sent that letter. Phoned bank up today and spoke to a v. helpful lady, who had a note of my 2nd letter but she informed me that they bank legally has 8 weeks to reply to any letter. I thought this was a bit extreme as you could write a small novel in that time! From what I've read online the banking code states 5 days to acknowledge reply 4 weeks to reply with final response or letter stating why they need more time 8 weeks if they need more time (but 4 week letter should have been received) If this is the case then its another example of the delay tactics used by banks and the armament of excuses they have trained their call centre staff to have at their disposal. I’m just posting this really because its useful to have a list of standard bull that you’ll be told and useful to have a response
  3. Sent initial request for statements for 2 accounts on 6th Nov, received them on Sat 2nd Dec. Except statements for current account only dated from Jul 2003 so phoned up and requested that remainder were sent out immediately (no doubt sending out onle half statement is a standard tactic from bank) Added up charges for Bill Payment account and in the space of 11 months the charges come to £1108 . Due to some sort of administrative error by bank member of staff my bill payment account was never configured so that enough money was going into account to cover my bills (all bills were fixed) so over a period of time it went into unauthorised overdraft and then i was getting hit with £30 charges for every DD going through account. The account was never more than £200 over its limit as money was always going into it and yet bank charged over £1000 in that period, evidence in itself that their charges do not reflect the cost of administration. I've compiled the spreadsheeet and am about to send it of, but would like to know if i should send it to local branch where account held or head office in Edinburgh. The bill payment account was to cover bank of scotland loan as well and because of admin error on it i incurred equiv penalty charges on the loan as well, is it possible to also claim these back? As a side note, I live is rural community in lowland scotland and went to my local branch in early 2004 to ask if the bank could accept some responsibilty for failure to configure bill payment account correctly (NOTE Some, being the operative word) I was told that the problem was entirely my fault for having my quote "head in sand" and that bank would not refund any of the charges. I also at that time didn't have a full list of statements and asked if they could print of duplicates and was told it would cost £5 per statement!!! This website has been a real eye opener, even in a local branch in rural community the bank have their staff well trained and have turned them into corporate monkeys. I knew the person i was talking to reasonably well and even then he couldn't bring himself to give me my statments or at least be honest and say it would cost £10 under data protection act.
