  1. Even bigger result, just found out the offer DOES include the extra £120 that i spent taking them to court plus an extra 20 quid!! Maybe they aren't so unreasonable after all plus. LOL
  2. Its 14 days from the date of service which is calculated as 5 days after the intial request unless is was specifically served on them before that I believe. Unless they file an acknowledgement of service which then gives them an extra 14 days.
  3. See my post above "Show me the Money". They did exactly the same to me ignoring my LBA. I ended up emailing [email protected] and he came through for me and they settled in full. They have a massive backlog at the moment obviously. I had alreday started my legal aciton and will lose that cash so it may be worth emailing them to see where your claim is at.
  4. Just a quick note to say that RBS have contacted me today to settle my claim in full (£1554) without going to court. As i have already started procedings i will lose the £120 it cost to take them to court but thats a small price in my opinion. I would like to say thanks to all the people who have replied to my posts while doing this and my support donation will be on its way as soon as the cash is back in my bank account. For information Sandy Watt (seen his name in a few posts) told me that he no longer deals with these claims even though his name still appears on the letters. Email appeared to be the best way to contact anyone at RBS in the end.
  5. I hope someone who has used moneyclaim online may be able to help me out here. I have submitted my claim on 23rd January and the website still shows a status of 'issued'. Does this mean it is still being processed before being served to RBS or has it being served, and when does the 14 days for them to respond commence from? Should i receive anything from the courts as i havent had any hard copies of documents yet? Any help would be appreciated.
  6. Ok peeps, i know i'm asking quite a few questions but i wondered if anyone else has experienced this or is aware whether my claim may be compromised in anyway by the following situation. I wrote to RBS with LBA on 28th Nov I has no response so sent a further LBA on 22nd Dec saying sort in in 10 working days or else i'll take you to court. I got a leter from them acknowledging my letter on 11 January saying it was being processed so I started legal proceedings on 24th Jan as they hadnt met my deadline. I spoke to them today and they said it was still in their system and obvoiusly they hadnt recieved my letter saying we're off to court and the Court documents themselves. It look slike we've got to corssed purposes due to their backlog etc, does this potentially impact my case against them or should i just stick to my timescales?
  7. Just need some advice. Is there any way to stop charges being applied to my girlfriends account whilst I have a MCOL claim ongoing against RBS on the account.
  8. Sorry to be a pain, another piece of advice please. I have submitted my MCOL and noticed inthe standard text from this site that i would provide them with "a list of charges again" (they've already had the list twice in previous correspondance). Should i write to RBS informing them that i have taken legal action and include the charges schedule with this?

  10. Evening all, I have a quickie i hope that I'm sure someone will be able to help me out on. I have outstanding charges with RBS and have sent my LBA (twice) to which they have not responded on either count. I am now going to go after them on moneyclaimonline, as RBS's registered offices are in Edinburgh do i need to get them through the scottish system even though i live in england. If i do go through the english system who do i put down as the people i am suing, the branch, the branch manager, the company (and its edinburgh address), the chief exec personally? Do RBS have an english registered office does anyone know? Any advice would be appreciated.
  11. Afternoon all, I am about to start my MCOL action against the RBS for unlawful charges after they fobbed me off with a letter saying i was wrong. Can anyone advise on whether you address to the Business (either at the home branch or their head office) or do you make a claim against a specific individual (either the local branch manager or the chief exec for example). And also as i live in England and bank their but the RBS head quarters are registered in Edinburgh does this effect whether claims are made through the English or Scottish versions os the Small Claims? Any advise would be appreciated, wish me luck.
  12. My apologies for this post potentially being in the wrong section. I would like advice on where to file my county court claim letter from RBS saying they would not refund the charges I requested. Do i file it in Scotlans as that is the location of their Head Office or do I file it in England as i live in Bolton and the account is with the Bolton branch. Any advice would be appreciated.
