Hi Guys

Could someone look at this agreement to see if it is enforceable.

In the top right 4 to 5 digits of the agreement number are missing and also the word "Bank" and maybe PLC also, so not even sure it is a flip side scan.

 

The T/C were on the back of the scanned copy sent

The agreement is not properly executed because it should have a heading "fixed sum loan regulated by the consumer crredit act 1974" which it doesn't have. It is therefore only enforceable under s65 of the CCA 1974 bycourt order. The court's powers to enforce it are limited by s127(3) but, in this case, since it has the debtor's signature and the terms prescribed in schedule 6 of the Consumer Credit (Agreements) Regulations 1983, a court would be able to enforce it, and almost certainly would do so.
