    • I'm not sure we were on standard tariffs - I've uploaded as many proofs as I can for the ombudsman - ovo called last night uping the compensation to 100 from 50 pounds for the slip in customer service however they won't acknowledge the the problem them not acknowledging a fault has caused nor are they willing to remedy anything as they won't accept the meter or formula was wrong.   I'd appreciate more details on the economy 7 approach and I'll update the ombudsman with any information you can share. 
    • To re-iterate and highlight my urgent question on this one: The N24 from the court did not include any instructions to submit paperwork 28 days before the date, unlike the N157 received for other smaller claims. Do I have to submit a WS for this court date? Link has!...
    • No, reading the guidance online it says to wait for a letter from the court. Should I wait or submit the directions? BTW, I assume that the directions are a longer version of the particular of claim accompanied by evidence, correct?
    • Thanks for opening, it's been another rough year for my family and I've procastinated a little.. Due to the age of my defaults on this and other accounts (circa 2021), I really need to avoid a CCJ as that will be another 6 years of credit issues. Mediation failed as I played the 'not enough info to make a decision' however during the call for some reason they did offer settlement at 80%, I refused. this has been allocated to small claims track, court date is June 3 and I've received their WS. I'm starting on my WS. They do appear to have provided everything required of them (even if docs could be reconstructions). Not really sure what my argument is anymore but I do want to attend court and see this through. Should a judgement be made against me then I will clear the balance within 30 days and have the CCJ removed - this is still possible isn't it? I'm going to be reading up today and tomorrow and hope you can provide me some guidance in the meantime. Wonder what your advice would be given the documents they have provided? I am now in a position to clear the debt either by lump sum or a few large installments - Is this something i should look into at this late stage? Thanks as always in advance
    • I have now received my SAR. It includes a great deal of information! Is there a time limit on how long account information is kept and/or can be provided to debtors? I have received many account statements which were not previously sent to me. I remember that the creditor should provide explanations of any acronyms and abbreviations that maybe used in the documents. Is this still the case? Also what, if any, are the regulations in regard to adding fees to a debt? Can fees be added to a debt after the court has approved a charge on a property. Perhaps due to the numerous owners of the debt, many payments I made were not properly recorded on the account, some were entered over a year after the payment was made! Following the Legal Charge, I paid every month until my payments were refused. I am trying to compute the over payments, but the addition of fees etc. is confusing me. Any comments and/or help would be appreciated.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The replies to my first post have given the courage to ask for help with this one also.

 

I CCA'd 1st credit on 17/05/07 and this is the reply recieved from them...

This is standard gumph from 1st Credit. File it and pull it out when you need to. It is basically an admission in writing that they cannot comply with the relevant Acts of Parliament

And if they do ever send you something that looks like an agreement make sure that you scan it in. It will probably be unenforceable for a number of reasons.

Hmmm...had a call from 1st credit at apporx. 17.10 today.

 

HELP!!!

 

Surely after the letter they sent me they should know the account is in dispute, especially as the caller said it was regarding my latter dated 17th May...

 

Luckily, was on guard after reading threads on here and told the caller that I expect to hear from them in writing early next week...

 

Should I now send a letter asking them to conduct all business in writing?

 

I'm a disabled single mum and it's taken me an hour to calm down from the call :(

 

Don't these people (I use that term loosely of course) have any sense whatsoever? They've had thier CCA and acknowledged it...and it's a Bank Holiday weekend...grrr!

 

I'm ok now :) Because I know I've got you kind, generous people to help ;)

If you stridently and repeatedly order 1st credit not to phone you they will eventually stop.

 

The will then start sending letters asking you to phone them. If you e-mail them telling them to write, they will send a letter asking you to phone them. And so on...

Number of times I've asked 1st Credit for information that I stil haven't recieved... 55 as at 02/05/07 :!:

I reported this lot to the OFT. They told me on the phone the only way I'd get a copy agreement was if it went to court, and then if I lost I'd be liable for legal costs. I settled but wish I hadn't now. The judge would hve been quite interested if they turned up with the copy agreement ages after I'd asked for it. Report them for harassment!

A+L S.A.R - (Subject Access Request) sent 28th July. Statements rec'd 01 Sept. Letter requesting repayment of £4,979 sent 18/09 MCOL sent 15th Nov £6389.57. Cheque received £6425.54 4th Dec.:D

MBNA S.A.R - (Subject Access Request) sent 28th July, promised reply by 28th August. Cheque rec'd £250 31 Aug.:confused: . 2nd letter sent 7 sept for rest of charges to be returned. £243 rec'd 28th Oct:D

CCA sent 1st Credit 11th August, reply 15th Aug

Request for repayment Rooftop Mortgages for £1095, reply saying no on 17th Aug.

Still to come: Cap. One, Time retail, HFC Bank.

babybear39, just rememeber, this is not personal, they know nothing about you, and care even less. I know it is hard to not act non emotionally when they call, as you think you are speaking to a human being:eek: get tough girl it's the only way to survive.

We know what you are going through, that is what counts.

Am learning quick and acting on advice.

 

Sent letter advising communication in writing only yesterday.

 

When I initially started getting calls from these 'people', I foolishly made the mistake of telling that I'm longterm ill and disabled, then got the classic series of horrible calls from a guy there. BIG mistake!

 

Anyway, back to it...

HELP!!! PLEASE!!!

 

Just had call from the [edit] guy at 1st credit :(

 

The conversation went as follows:

 

He asked for me by name, I asked who he was and which company he was calling on behalf of, he said 1st credit and I then said that it was me...I calmly advised that I'd CCA'd them on 17th May, also sent a letter re: telephone harassment on 29th May and politely informed him that I'd requested on numerous occassions that all future contact will be conducted in writing only (during the convo he continually tried interupting me and trying to make me answer 'security' questions). He then persisted in an intimidating manner which I interupted advising again calmly that he was now breaking the law re: harassement...Then I hung up.

 

Did I do ok?

 

And what do I do now?

 

Now I feel like absolute sh**e again and feel like crying... :Cry:

You did fine.

 

You may want to think about call barring on your phone though.

Alternatively you could get caller display. Log all calls they make - it will help with a harrassment case.

 

If you choose to answer their calls (remember you don't have too, it is after all you phone line) you may wish to not confirm who you are, that way if they continue they are breaching The Data Protection Act.

Alternatively you could just play music down the phone to them - I believe jesus wants me for a sunbeam is a site favourite.

Thanks for your help rory32 but I don't have means to screen calls and am sitting here waiting for an urgent call regarding a medical appointment.

 

It's making me terrified to answer the phone but I have to :(

 

Hopefully they'll lay off when they get my recorded letter sent yesterday re: phone harassment :confused:

 

Starting to make me wonder why they're breaking the law and being so agressive though...Hmmm...Makes me think they're doing it because the CCA isn't and never will be available :confused:

I've pulled myself together and shot off an e-mail requesting copy of thier complaints procedure and had an auto response saying they're dealing with my request :)

 

Will keep this updated as I think it's going to have many twists and turns...

After calming down, and knowing that the harassement letter will arrive with them tomorrow by rec. post, I think I'll let them 'dig' themselves into a deeper hole just yet. More amunition for me, more charges against them :)

 

This site is really boosting my confidence with dealing with these vultures, and with every positive action I take I feel more able to cope.

 

I'm going to use the tactics suggested, note all calls and make myself not affraid of my phone :D

 

Maybe I'll go to the loo while they hang on or is that too gross lol ;)

Anyone concerned about harassing phone calls from DCAs will find the 'Broken Record' technique useful.

 

Write down a script, such as: " I'm not prepared to discuss this matter on the phone, as your office is aware. Please put all communication in writing."

 

Keep the script by your phone, or conceal it cunningly about your person so that you will always have it to hand.

 

When the DCA calls, read out the script; nothing else. Don't get drawn into conversation, don't respond to threats or questions, just read out the script, over and over again, whenever it's your turn to speak. You need to repeat it because they will not actually be listening to what you have to say (unless or until you cave in to their demands). You may like to hang up after the third or fourth time, but they're paying for the call... They won't last long, anyway, because they'll realise that you aren't going to give in, and anyway the repeated refusals to engage with them will help them get the message that phoning you will be a waste of time. It will also put you in control of the call, which will make them feel very uncomfortable, and you feel more confident.

 

This is a legitimate technique that is used in counselling - and interrogation (and resistance to interrogation)! Try it - it does work!

We need a sticky, a list of ways to deal with DCAs phone calls, then depending on which day of the week it is you chose your response.

monday whistle air horn day

tuesday loo day

wednesday recorded script day (sorry SP do not want to waste any breath on them.

thrusday sorry this is a bad line, sorry can't hear you etc etc day then leave the phone by the washing machine (make sure its on)

etc etc
