Default Joint account closed because of seperation/divorce?

Hi there:

I have decided to help my sister out with her claims - I told her about this opportunity and she indicated that she has a had a fair amount of bank charges over the last 6 years with Clydesdale. Some on her individual accounts - but most she indicates on the joint account she had with her (now ex) husband.

I have had a look through FAQ & done a general search - and found this

Can my sister claim on joint bank accounts that are now closed where they were under her and her ex husbands name and they both had joint authority? It was not an amicable split and so she wouldn't want to involve him in the process. (He wouldn't have even thought about completing such a claim - so there's no worries that he got there first.)

Sorry not to answer sooner. You are quite right that your sister can claim separately although Clydesdale have been quite difficult about this and threatened to strike out a lot of claims where one person has claimed on joint accounts. They don't seem to have succeeded yet, and I see no reason why they should. One person got full settlement on condition that her other half signed to say that he wouldn't claim, but they should not be imposing conditions. Give it a go.

thanks Caro. I've typed her up the letters to send to get infor through data protection - she now just needs to send away withe cheques. think she's a little wary though so she may wait until mine is settled to see how it goes if you like. I've told her that noone has lost yet but shes still wary.

Only one cheque needed if she lists the accounts on the same S.A.R - (Subject Access Request).
The S.A.R - (Subject Access Request) pertains to the individual not the account.
