has anyone actually had thier stay lifted yet has anyone been paid out since oft announced test case just my case is on a stay and i was told to sit tight and wait till test case is finished unless i had a real reason for having the stay lifted ie hardship is this what i should do thanx any adivce would be great

Hi Goodgirl

Having been hacking away at YB since March and with a Court date set for Oct 4 which Tobydoby was looking forward to it now appears everyones claims are on these stays thanks to the OFT!

I too would be interested to hear if anyone has had a judges ruling against the banks rather than the banks taking advantage of these time wasting stays of which who knows which way it could go in the end

Was anyone successful at the Leeds Mercantile Courts this week ?
Be great to get some feedback out there

Another site was successful last week in getting a stay actually lifted. This was done by arguing the hardship grounds and special issues around the claim. As far as I am aware this is only the second time (since the announcement) that a stay has actually been lifted.

There seems to be little chance of success unless the grounds are extremely strong, and argued in the right way.

Hi my sis was at the Mercantile Court on 29th August and the hearing was 10.30 she was there all day - whilst the judge ruled a stay on all cases she did feel that the judge was on the claimaint's side he was really nice to everyone and made everyone feel at ease - there were a lot of funny stories came out that day but this one I could really relate to: the judge gave everyone opportunity to speak some did most did not! however this chap stood up he was between 50 and 60 he had a handwritten piece of paper in his hand and the judge said "would you like to read it out to me" the chap looked at the judge then back at his papers and said "I am really sorry but you will have to read this yourself I cannot stop shaking"

Bless him! I wanted to add my sister was petrified you would think she was facing a life sentence and whilst she chose not to say anything she said she would never be nervous again because they do make it as easy as possible for you.

This is only her opinion but if you knew her it would count for a lot.

must admit i feel as if im throwing away more money on trying to remove the stay on my claim i have to hand it in by 4 pm tommorrow an my case should of been heard on the 7th its so dishearting to get so close to getting my cash back to have it snatched away again ......

thanx for all replys will watch site very carefully till test case is finished it makes me mad that i was so close to getting my money back too but i guess we will have to wait and see if oft brings a good result our way for a change
