Received info from Data Protection Act request,two sheets of A4 with penalty charges listed over 6yrs.Sent prelimary letter 05/06/06 requesting return of penalty charges £960 over last 6yrs.Now waiting with everthing crossed.

Received letter 29/07/06 from are freind Mr Voller.
May I say how sorry I am BLAH BLAH,I am willing to offer £475 towards the amount you are claiming as a goodwill gesture.
Letter sent today accepting as a interim payment,informing them that I will be continuing court action to recover the full amount of claim inc court costs and interest.

There are lots of good threads around with info on what documents you should need for court. There is a comprehensive list by jonni2bad (I think in his thread with halifax) which gives a detailed list of what you may need. in the meantime start with these -

A copy of all correspondence with the bank.
A breakdown of charges + interest.
Unfair Contract Terms Act 1977,
the unfair terms in consumer contracts regulations 1999
A copy of the OFT Report on Default Charges

Five days to court date,not heard a sausage from anyone,court appearance looking more and more likely.Although still plenty of time for a settlement.I will keep you guys/gals posted.
