Hello - my first posting

Just joined the group and finding it all a bit daunting!! Not familiar with forums so taken me a bit of time to find my way around. I have sent my first letters to NatWest and the Woolwich. The Woolwich responded immediately and sent back my £10 cheque with a letter saying they are investigating my complaint and will respond by 17th April. Can you advise what I should do, wait for a response or demand they send my statements? Thanks.

When you send a Data Protection Act SARs request plus the £10 fee, they have 40 days in which to comply with your request.
I assume from what you say that you've just sent the letters. If that is the case then you are still well inside the 40 days

Spend a few days reading the FAQs and the step by step guide in the library section. That will answer most of your initial questions.

Thanks Rooster. Will spend some time reading the FAQ's but as the Woolwich have returned my £10 cheque for the Data Protection Act S.A.R - (Subject Access Request) request, can I assume I'll get my statements within 40 days so should wait or contact them again?

I would assume that as you sent the letter asking for statements under the Data Protection Act law, that it is now deemed as being served to them and that they therefore have 40 days to respond.

The fact they returned your £10 cheque for the statements to be sent, in my opinion, is irrelevant, as you made the gesture to pay for the statements and they refused it so what more can you do?

Dont take this as professional advice by any means, but that is how i feel it would work if anyone tried to argue the point.

Babylove's got it right. The fee's the maximum they can charge, your letter (if you used one of the CAG templates or similar) is a valid request so effectively they've said they'll supply it for free, but as noted they've 40 days from receipt to deal with it.

Hi, when i applied for my statements of charges last year the woolwich also returned my chq for the £10 charge, they waited for the full 40 days though before i received them.

Don't be daunted, you have plenty of help here!

It's a long battle but you will win, Woolwich take everything as far as they can in the hope you will bottle it and cave in. Just stick to your timescales and get what they owe you

Got a schedule of charges from the Woolwich and have sent the next letter requesting refund. Have received a response to say that they are investigating my issue and will respond by 29th May. Should I wait for their response or stick to the timeline and lodge a court claim in 14 days?
