Default rainbow005 v The Woolwich

Evening all,

this is my first post, firstly to say 'hello" and secondly to start off my thread for reclaiming my charges from The Woolwich.

13th March: sent off S.A.R - (Subject Access Request)
15th March: received standard letter stating "...we aim to resolve this issue by 13th April..."

I've been reading the content of this website pretty much solidly for the past two weeks, what a great resource. As 'up to speed' as I feel I am on the procedure for this process, I know I'll be needing help and support as it unfolds and it's good to know that everyone here is so focused on helping one another along the way.

Had a letter dated 12th April presenting an offer of £769 for charges totalling £1,025.50.

I've written back to them today saying I will accept an offer of £897 (being £769, PLUS 50% of the difference of what I'm actually owed).

They can only say no!

Well, they did say no! After 'careful consideration', apparently!

Preliminary letter going off today for refund of full £1,025.

Hi, quick update. No correspondence received in response to preliminary letter for repayment sent on April 20th, so letter before action going off today.

Update:

no further correspondence received from the Woolwich so I picked up the necessary forms from the court today.

One question though: there's not enough room on the form for all the required text, but I can't seem to find any 'formal' continuation form. Therefore, I assume I just continue my particulars of claim on a separate, plain sheet of paper, headed up with my name and other pertinent details?

Is that right?

I'm also planning on requesting repayment via a cheque and NOT by direct credit to my bank account. Has anyone else specifically requested this on the N1?

Thanks,
Kirsty

OK, I've just read through the step by step guide to reclaiming again and can see that I should request repayment by cheque.

So, just the other question remains on whether there is a 'formal' form to use in regard to continuation of my particulars of claim.

I have used the MCOL and then just sent a seperate sheet with my charges to the Court and asked them to attach them to my particulars of claim.
