Hi there everyone , i have been reading these threads with alot of interest i did send the woolwich a prelim letter asking for a refund of £582.00 enclosed a list of the charges and i got the usual Blah Blah reply.
They then offered me £330 as goodwill on the03/03/2007 i rejected i wrote back saying would accept as a partial payment and gave them 14 days to pay the full amount which had now increased to £652 due to them adding a further £70 to the account.
They replied on the 13/03/2007 offered upped to £489 as goodwill i refused and gave them a further 7 days and then they wrote on the 15th saying no further increase in the offer and they acknowledge that i intend to take it to court so should i progress to MCOl now advice please help!!

If you have sent the LBA (letter before action) , then it's MCOL time.
If not, then send the LBA (in templates library) giving them 14 days "in which to reflect".
If no acceptable reply received within 14 days, then straight into MCOL without any further correspondence

Have you done an updated schedule of charges to include the latest ones? If you send a LBA then enclose a copy.

thanks alot for that Rooster will get a LBA off today and a revised charges list.
I have no added any interest onto this amount as it is not an overdraft account i just have a £50 buffer zone but a soon as i go over they start slapping the charges on and charge me for the charges its madness will keep you posted.

i have sent off another LBA off today with the updated schedule of charges and given them 14 days or it is MCOL time they had only offered me £489 and my claim was £652 i do not think they are going to pay up so it is them that will end up paying more. !!!

because i am quite sad i had all of my statements for this claim (last 4 years) i did not have to do a S.A.R - (Subject Access Request) request so therefore do not know if there has been any manual intervention on my account and due to now at the LBA stage how badly could this affect my claim as i do not think that they are going to give me any more than the £489 already offered how can i get around this ??? :o

Hi Trying to save,
I don't think you need to send an S.A.R - (Subject Access Request), you have your statements, you have made the preliminary request for your charges to be refunded, why settle for less its your money, tell them you will accept the £489 as part payment and you are ready to make a claim for the balance, there are templates in the library for this, i think its a case of who blinks first, don't give up please, you will get loads of advice on this site, let them tell the judge about the manual intervention and give a break down of what the intervention cost them, out of the replies I have had from the banks, it has not been stated that at such a time there was manual intervention, they usually say there might have been!!!

i have received a reply from the Woolwich dated the 27th March the usual Blah Blah Blah letter and even though i quoted my old ref no they had given me on their previous letters they have now given me a different ref number and the usual flannel that they will reply to my complaint by the 26th of April ha ha they have the 14 days that i stated in my LBA or off we go to the courts as from the previous correspondence with them i don't think that they are willing to pay me the full amount owing
