Mike.

Do not send this! This letter refers to Court proceedings and their defense which you do not have yet.

You must issue them with Court prodeedings before 'any' attempts at negotiating a settlement.

Also, this letter didn't really get me anywhere other than give Mr Jeramiah the chance to try and get a reduced settlement.

My advice now is to issue Court proceedings and then sit back and let them sweat.
You will get what you want, eventually.

Hi Mike,

Yes I did read that change BUT I still advice very strongly not to send this.
You will not get the settlement you desire if indeed anything.

You would be much, much better off following the tried and trusted methods that this site advocates. We know it works!

Having read your thread I would say that you have given them more than enough time to comply with your request and you are now in a position to issue Court proceedings immediately.

The ball is then very much in their court and you call the shots. Until you get yoiurself in a position of strength you will get nowhere.

I hope this helps,

Barry

Talk about slow - rang the court yesterday - it was only issued on Mon - 12 days after I submitted it!

At least it's done now.

Recevied notice of issue AND notice that acknowledgement of service had been filed this morning...

"The defendant responded to the claim indicating an intention to defend all of the claim"

Pretty std response I think?

Hmm, here's a question - Date of service was 24/09, so in my mind that gives 14 days to = 8th oct, which was a Sun... Little girl chopped her finger off on Sun and was operated on Mon, so managed to call court on Tues, 16 days after service to check if defence received as wanted to apply for judgement by default.... Told by the court, that as they acknowledged service and an intention to defend, they actually have 28 days to file defence - is this correct???

They have 14 days to acknowledge the claim, and if they do, that will buy them an additional 14 days to file the defence. This is standard procedure for Barclays
