Default noomill v woolwich 2.0

Oh dear, the Wooly Monster has charged me for another failed direct debit, despite being warned what would happen.

Here we go again...

Woolwich Bank
1 Churchill Place
London E14 5HP

13 March 2007

LETTER BEFORE ACTION

Dear Sir/Madam,

ACCOUNT NUMBER: XXXXXXXX

I am disappointed that you have failed to respond positively to my letter of 20/2/07.
I understand that the regime of 'fees' which you have been applying to my account in relation to direct debit refusals, are unlawful at Common Law, Statute and recent Consumer regulations.

I would draw your attention to the terms of the contract which you agreed to at the time that I opened my account. It is an implied term of that contract that you would conduct yourselves lawfully and in a manner which complies with UK law.

I calculate that you have taken £35 in unpaid Direct Debit fees. I am enclosing a copy of the schedule of the charges which I am claiming.

As I have already sent you a warning of the action I would take were these unlawful fees to be debited if you do not comply fully within 7 days, I shall begin legal action against you for the full amount plus interest, plus my costs and without further notice. (A copy of my letter of 20/2/07 is enclosed)

Yours Sincerely,

noomill060

Funny this is, I phoned them to give them the opportunity to remove the charge and was told that the only do one "goodwill gesture" a year. (I had a similar charge removed in September)

Goodwill gesture, eh?

They can keep the blue paper clip holding my LBA documents together, thats my goodwill gesture to them!

Got a letter from Woolwich/Barclays this morning saying they dont agree with my legal argument, they dont consider they have done anything wrong, but that they will credit my account with £70 to make me go away.

Got another charge for going overdrawn as a result of the previous charges last month- after a few letters they agreed to refund all charges, which they did, in fact they paid £30 more than I asked for!

I then withdrew every last penny and closed the account before they could mess me around again!

(Left the branch singing "We Wont Meet Again"....)
