Hello all i sent off my S.A.R - (Subject Access Request) on the 23rd of February and received a letter 'Thankyou for taking the time and trouble.......M.wallis' with my cheque included with a date stamp on the back, i hope this is all normal i used a slightly edited version of the letter.

When should i expect them to actually reply properly?

They are allowed 40 calendar days from receipt of your request. Actual time will depend on their workload (they might be busy at the moment ) and their current policy on how quickly they turn these things around. Once it gets to around 33 days (when they've a week left) give them a nudge if you've heard nothing.

Thanks for the reply thought that was the case just wanted to get an opinion, i've asked for details of charges, any action needed from their staff and any defaults registered is that appropriate?

Well to my suprise i got a letter from the woolwich today listing charges, date applied, type of charge totalling £677 which is nice.
However they didn't include if any where returned or if they had made any defaults on my record as i requested.
They say if i have any further queries to call them.

What should i do ??? Request the info by letter or just send them a preliminary letter?

Send them the preliminary letter with the spreadsheet of your claim. Include in your letter that you expect associated default in your credit file to be removed as it is unlawful.

I think it is a good idea to order your credit file from Equifax or Experian or Callcredit for only £2. That is the way to identify all defaults and late payment markers including the one you may not know about.

I just realised my intial letter didn't ask for all the transactions can i still ask for this
I am planning to send lba as i requested manual intervention info and default info and didn't receive either and was going to add the full transaction request as a footer to that .

How does this look ?

LETTER BEFORE ACTION
Section 7 – Data Protection Act 1998



Dear Sir/Madam

Account: Customer Reference:

I am in receipt of the documents that you have supplied in response to my Data Protection Act information request dated
23 February 2007. The disclosure of personal data is incomplete in that at least the following documents are missing.

You have provided no notes, or documents relating to instances of manual intervention or acknowledge that there has been no intervention.

You have provided no information as to whether any default notices have been entered against my credit record.

This is not an exhaustive list by any means, it is just an example of some of the information I am missing.

Accordingly, I have to tell you that you have not yet complied with your obligations under the Data Protection Act 1998.

You have a further
12 days to comply.


Furthermore since the original subject access request I have researched this subject further and discovered that I may request a complete list of transactions for this account, as such I hereby request that you provide me with a complete list of all the transactions for this account from 23 March 2001 to the present day. As this information was not included with the original request the original deadline does not apply to this extra information however I do require you to acknowledge by 4 April 2007 that I will receive all the above listed information.

I will suggest that you remove the last paragraph because it is not relevant. Most banks provide all the data and more.

The other part of the letter is OK but remove the last paragraph.

I believe that the woolwich is witholding info about charges before a certain date, thats why i added the extra should i send another S.A.R - (Subject Access Request) they haven't told me about manual intervention or defaults i know there has been manual intervention but can't remember when.

I spoke to them yesterday to ask where my info is they said they would send it within 21 days its already 18 days late, should i send them another lba stating they havent complied and that i will be seeking compensation and pre-action disclosure? in court
