I have a closed Woolwich account and have been in the process of claiming charges back for around a year. It took them 8 months to provide me with statements from the accounts startup some 6 years ago. I wrote them a letter saying I want these charges back and got a reply saying it would take them 4 weeks to look into. After this came another letter from Barclays Head Office saying they would look into it. A few weeks past and I received the standard " You agreed to our terms when you opened the account so go away" letter.

I sent the LBA 3 weeks ago with a list of the charges (without 8%) using the spreadsheet from this excellent site. I have not received a response. It is three weeks because it is payday wednesday and as with many people that is when I can afford the Court fee. I have registered with MCOL and intend to file the claim for ₤1450 + interest on Wednesday.

I cant believe they have ignored the LBA and have not even made an offer to settle prior to a court claim.

I will keep you all informed. Feeling a bit anxious about spending out ₤120 which is a lot to us at moment!! But hey here goes. Watch this space.

Thanks steve - I'll be doing it tomorrow (wed 28th) - I've seen the reports on BBCs Watchdog last week and in the news. Bit worried that they will up the anti with the influx they will receive in cases against them and somehow close the gate. I will post here again tomorrow to confirm claim started.

They will string you along till eternity unless you send them the correct letters and in the in the correct order.
And if you had followed the above, you would in all likely hood have repaid your money by now .
Anyway rant over settle down and do a few hours of reading, not only of the above but also the Woolwich forum, so you can see how others have successfully reclaimed their penalties.

I have now filed the claim with MCOL and sent a list of the charges and covering letter to the court. Not sure if I need to send list of charges to Woolwich/Barclays again? Fingers Crossed

Update - I have received the paperwork from the court to say that the claim has been issued. They have till the 20th March to reply. I also sent the bank the list of charges again. Let the wait begin!

Good old Barclays/Woolwich true to form have not yet acknowledged my claim. 19 days past the date papers processed by MCOL is tomorrow (20th). Reading the posts here it seems likely they will acknowledge tomorrow to give them 14 days to defend. If they do not acknowledge then I will enter Judgement in default, realising that they can still acknowledge within 48 hours of this. They must be employing more staff now to keep up with this!

And I hope lots of you saw the BBC Whistleblower program tonight! A previous employee of Yorkshire Bank calculated the true cost of a bounced DD/cheque to be two pounds at the most! Barclays featured predominately and (some of) it's employees were to seen to laugh at charging those who could least afford it! Barclays/Woolwich lookout - the consumer fights back.

At the last possible moment, they have defended saying they dispute the whole of the claim. It is now to be passed to the local court and no longer dealt with by MCOL. I guess allocation questionnaire is next. Is it worth phoning them now to stop wasting the courts and everyones time? OR carry on towards a court date? Any advice welcome

From personnal experience untill you get some sort of hearing (allocation or direction) they will hang it out till the end.
When you get a date leave it till 3 weeks before the hearing to phone their legal dept.
Just sit back and read CAG for the next couple of months

I have now received their defence in writing from MCOL and it has been transferred to my local court. It has been directed that the AQ be dispensed with! I understand from other threads that this will speed things up in our favour and stop the banks abusing the court system. I will be sending letters to the Woolwich and my local court on Monday as suggested in the latter parts of this link . Again views of any others appreciated. I think we are approaching the finale!!

An update to my case - This this now been block listed with a number of similar cases for 25th July - documents to be filed by 11th July. I have had these dates since 20th April! Must start thinking about documents for this.

Hi iwcd

Have you been reading the threads on this forum. The advise is that Barclays are setlling most claims that are within 3 or less weeks to court date.

Stick a new thread om the main Barclays forum if you like as that gets far better exposure (and more replies) than the sub Woolwich forum.

You'll get lots of advise on which tel number to call and how to word your enquiry giving them opportunity to settle.
