Order for possible strike out of Defence

Hi everyone

Having sent in my AQ, have received order for directions stating, as with the member who issued in Lincoln, that "The Court of its own motion is considering striking out the Defence as an abuse of process. The basis for this is the fact that the Defendant is settling all claims of this nature where Claimants are seeking the reimbursement of bank charges with no claims proceeding to a contested hearing......."

Should I try calling the Woolwich to see if they will settle now or should I wait the 14 days given by the Court to see if the produce the schedule (which I assume they won't) and then let the Court strike out the defence?

Don't call Woolwich.
Let them contact you, which they should do any time now.

Great news for you bunglebin, could I ask which court this was?
Mine has just been transferred to Southend.

Steve 31 - it was Boston CC. Seems to be a Lincs thing at the minute - might even have been the same judge.
