| Re: Request letter typed but worried I've noticed that the defence letter Barclays send always says that the claimant has failed to give details of the bank account held and the charges. I have the spreadsheet with all the charges on when do I need to give them this information? |

However I have made a mistake which I guess I'll just have to live with. I misunderstood about adding on interest and although I put all the cut and paste text in my claim particulars with the correct amounts I didn't add it on to the amount I am claiming. As I'm hoping it won't go to court anyway I'll just live with the fact I may forgo the interest. I've got more charges to claim for once this claim is over so I'll know what I'm doing then! |

| Re: Request letter typed but worried I can't see how it would weaken your case. The courts like evidence that both parties have tried to reach settlement prior to a hearing. However only call if you are confident in what you are saying, and if possible record the call. If you record the call make sure you are informing them that you are doing so.

| | Basic Account Customer | Re: Request letter typed but worried I called Keith Jeremiah, took a couple of attempts to get through but he returned my voicemail message, to say that as it was now a legal matter and, as they were not admitting liability, the bank needed to enter a defence and that once they had entered a defence to ring him again. They have to enter defence by 3rd of August and he said he would hope to have it entered before then.
Nothing ventured nothing gained and in some ways I'm glad I called as I now feel more confident to call once a defence is entered. Anyway not long to wait now. |

| | Basic Account Customer | Re: Request letter typed but worried As an aside to my ongoing claim, I this morning received notification of 3 further charges, note to self to remember that in the last few weeks of term schools may wait until the first week of the hols to bank cheques! As they hit the account just before payday, the bank returned them with a please represent and charged m,e £35 x 3 for the pleasure.
I thought I'd give them a ring and ended up having one of those conversations that made me despair., The guy on the phone was pleasant enough and said he would go ahead and ask for authorisation for a refund. He left me on hold for 10 minutes or so and came back to ask if I had received their offer of £900+ back in June. I agreed I had and had replied saying I wanted settlement in full, and that at present I was pursuing the matter in the court, that the claim had been acknowledged adn I was awaiting their defence. So he then said well they haven't received your reply so we'll send you another copy and then you can sign it again and that will be OK. Umm no it won't because that claim has absolutely nothing to do with the three charges I am now trying to get refunded. But its over £900 he said, yes and that is less than a third of what you owe me, and still has nothing to do with the three charges which I do not want you to take from my account next month. Ok well just sign the letter and
it will be OK. AAAgh do you understand this is two separate things. I see he said, that was for OTHER charges Oh I don't know it's all above my head, I'll put it in as a complaint and hopefully it will get sorted soon.
At which I had to laugh and we ended up chatting about whether they were getting many calls, he said not as many as expected but he guessed a lot of them were going straight to head office. He did finally understand what I was trying to acheive but I said not to worry I would put it in writing and if necessary pursue it again through the legal system. And of course to end the call "was there anything else he could help me with today?" Well if you are always as helpful as you were just now I guess not! |

Will the defence show up on Moneyclaim or should I be receiving something through the post? Should I allow them a couple of days grace or go for the default judgement, knowing they might ask for it to be set aside?
Any advice welcome |

| Re: Request letter typed but worried I received my defence, standard Barclays/Woolwich defence so I won't bother typing it all out, and allocation questionnaire which I have completed and is now ready to send. I am going to give Keith Jeremiah a call to try and settle this before court but am quite prepared to take this all the way if necessary. I'm not too worried about signing the confidentiality clause so hopefully I will be on here soon just to say goodbye to my thread if everything goes my way  |
