Default Bmwman v Woolwich

Hello everyone
I am claiming back £2266 in charges over past 6 from the Woolwich. Phoned the Woolwich on the 19/12/2006 requested list of all charges for past 6 years should I have also asked for statements and is it to late to ask for them now. Received letter from The Woolwich standard rubbish so sent a first letter from Govans Law website. Received letter from Barclays offering £1000 as jesture of goodwill. Refused this and sent second letter from same site on the 17/01/2007. Also should I be appling interest now or when I fill out the court papers, and who do I send them to if it comes to it.

bmwman you need to do some reading first dont take this up the wrong way but this is a self help site of course there are people here who can give you advice and help but you need to do some work yourself so you know what to expect in regards to your claim ! Start by reading the frequently asked questions section after you have grasped that read other threads of forum members claiming of the woolwich then you will understand the full process ! THE LETTERS REQUIRED TO SEND TO THE BANKS ARE IN THE LETTER TEMPLATES SECTION ! So in answer to your initial question about interest ! interest can only be added when you issue court proceedings !

Hello Again

Still not had reply from Woolwich/Barclays to last letter.
So i am starting to get N1 Form ready to file with court on 2nd Feb
but have 1 question most of my claim is made up of returned DDs but have a few Unautherised daily overdraft fees do I include these with the DDs or seperate in overdraft fees.

Not sure if you have already completed a spreadsheet of charges yet, basically anything that is a fee/charge include (including any interest that was added as part of a charge) service charges no matter how unfair they seem do not.

Continueing to fill out N1 form but not shaw on one part need some help please. Using template from this site. Under the section Headed VALUE=2266
entered charges interest under s.69=474.60
Enter court fee 120.00
Please could some one give me some help with next part on his section

This is the template I am using the part I am unsure about is:
have list all charges in spreadsheet this gave total for charges and the interest (not reclaiming overdraft interest as to small to worry about)
I take it that I add the total for charges to interest then in the part where it says (Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £xx.xx per day {(enter daily rate here - (CHARGES+OD interest)x 0.00022 = pence per day) }OR at such rate and for such periods as the court deems just). This is the part I am having trouble with.

This explanation might be easier I copied from the online version.

...at a daily rate of £0.xx; - This daily rate of interest is calculated by multiplying the total value of the claim (charges plus overdraft interest, if claimed) by 0.00022
For example,
£1,429 in charges
£27.40 in overdraft interest
Total £1,456.40
1466.58 x 0.00022 = 0.32 - This would therefor be £0.32p on a daily basis.
Please ensure you do your own calculation based on your totals


Basically when you have sent your claim, the interest on your claim continues until it is settled therefore, it increases by the above calculation each day.

But still a little confused have filled out simple spread sheet as I say mostly dds
In Respect of: Amount Date IncurredDays since offenceInterest 8% APR
UNPAID DIRECT DEBIT£27.5003/05/2002 1731£10.47
and so on this gives me the total in charges and a total in interest.
so should the form be filled as follows

Interest under s.69 County Courts Act 1984 £10.47
Court Fee £120.00
TOTAL £ 157.47

Plus interest pursuant to S.69 County Courts Act 1984 from date of issue to date of judgement/settlement at £0.00605 per day [/font]

or do I add the charges and interest together then apply the part in red.

seems a bit wrong that I cannot apply interest from the date they they nicked my money.


have been looking at some of the defences placed by barclay I have a question opened my account with woolwich building sociaty in sept 1998 signed forms to open account. In 2000 Woolwich PLC was purchased by barclays no new contract signed. This was then transfered to a woolwich openplan in November 2000 still no new contract signed. Should I write to barclay and ask for a copy of the contract or a copy of their terms and conditions signed by me.

Hello again every one re the list of charges you all have been receiving. In place of statements. Do yours show any charges that have been refunded to your account. As mine has not I found some old statements today and looking through them found 1 charge that had been refunded that is not on my list. I asume this is why it is important to get statements. Can I amend a SARs letter to suit my needs or would it invalidate it. YES I HAVE MESSED UP Hope I can Rectify
