Default Allocation Questionnaire

We got this today and we have set about filling it out and sending it back but there is one part where im not sure what to do and that is part F: Proposed Directions... What do we put and where please? Also, I seem to have a problem understanding the defence or part of it anyway, if i scanned it, would someone look please? we dont want to do this wrong.

put as much detail as you can on here we will try to help you ! also if you read the frequently asked question sections or the sub sections at the top of the first page bankfodder has put instructions on for filling these forms out so no mistakes are made have a read through the site while you are waiting its there somewhere !

Effectively it orders you to produce your Court Bundle (something you would do later anyway), but it also orders the bank to produce a breakdown of their costs, which they continue to refuse to do. Rather than do this, the bank would rather settle in full.
You would not have to do anything until the judge agrees to issue the Direction Order

Right, iv got that... Iv put them in the other info bit, is that right? I dont need to send another copy of the charges at this stage, do i? I wasnt going to... also, do I have to send a copy to the bank as well as the court or just send the aq back to the court? x

The proposed Direction goes in Section F:
New strategy for Allocation Questionaires

You are not required to send a copy of th AQ to the bank but it recommended as a courtesy, plus they will see the proposed Direction and hopefully settle sooner.

Put the proposed DO on a separate sheet and the below in Section H

I am respectfully requesting that my claim be allocated to the small claims track. This issue is not a complicated one; it is an issue of fact and not of law. The issue is only whether the money levied by the Defendant in respect of its customer’s contractual breaches exceed their actual costs incurred. I am happy to pay their actual costs and I am surprised the Defendant did not counterclaim for these, because I would have paid them without argument.

However, the continuing problem is, (in common with the 100s of other cases currently being brought by other bank customers), that the banks refuse to reveal the details of their penalty-charging regime. As the banks have a fiduciary duty towards their customers, they have a duty to deal straightforwardly and in utmost good faith.

Accordingly, I would respectfully ask that the attached draft direction be made into an order.

I believe this would bring a rapid end to this litigation
And keep a copy of the AQ for yourself.
