Hi Everyone

Just wanted to start by saying thanks to everyone involved in this site, is good to see consumers fighting back!

Was looking for some advice really.

Basically I am claiming for around £1500 and was following the step by step procedure and before christmas. So far I have only got to stage 2 but Woolwich (Or Barclays) have offered me half this amount before I have got to the LBA stage.

I'm not going to accept this as my account is currently nearly £400 overdrawn due to bank charges since I stopped paying my wages in.

My question is, as I have not reached the LBA stage, should I just send this letter http://www.consumeractiongroup.co.uk...ent-offer.html or should I also send them the LBA latter as well?

Many thanks for any advice offered.

HI Chris


Just write back a brief letter saying thank you i will accept the £*** as part payment towards my original claim of £1500. and i shall continue with legal action for the revised amount.

They will in 99.99% of cases withdraw the offer and you can carry on with the LBA.

And never send two letters in the same envelope they can always claim they never got it.

Chris just carry on as BIGAL has advised you to do ! in nearly all the cases against woolwich they have offered some amount to settle as a goodwill gesture but once you point out youll accept it as partial payment towards full amount they swiftly withdraw the offer ! so just carry on as planned and stick to your timescales not theirs remember your suing them so your in the driving seat ! good luck any help or advice you need just ask someone will be along to help you out !

Hi AL

Is this along the lines of what you meant?

Dear Mr East,


Thank you for your letter dated 4th December 2006, received last week.

I am happy to accept your offer of payment of £745 as an interim payment, whilst awaiting receipt of the difference plus interest.

Please note that if this is not acceptable, I intend to pursue my claim in the County Court for the full amount plus interest @ 8% pa.

Hiya, me again

Just wondering if someone can advise the best thing to do!

Basically things have progressed to the stage where I have filed my claim online and it was issued last Friday.

This is where the problem is, I was looking over the details and have noticed I did not enter my address correctly!

The first line and the post code are correct, but I entered the road name of an old address by mistake, is there anyway I can rectify this??

You could just send them another letter explaining the mistake including a new LBA , but send it speciel delivery £4.10 but it gets there by 10am next day.

Good morning

Have been away for a bit but my court date is getting closer so am hoping those in the know may be able to offer some advice.

I am starting to prepare my court bundle and have noticed, unfortunately, that my schedule of charges seems to have been deleted from my PC, and have lost my back up memory stick.

My question is, will it be ok to fill it out again, bearing in mind that it will now add on another 3-4 months of Interest and therefore come out with a different total to that I am claiming for?

Also I seem to have misplaced some of the correspondence received from the bank, will this affect my case in anyway?

And finally, do I have to include a copy of the T&C's in my bundle? I did submit my AQ after the amendments had been made, and cannot seem to find the T&C's anywhere!!
