Worzel V The Woolwich Can somebody help?
I've passed the Court Allocation Questionnaire phase, after which I have received a 'Standard Order for Stay for Settlement with Consent of all the parties'
It says:
"All parties having agreed District Judge Bazley Whites orders that this claim is stayed until 08 January 2007 pending the Office of Fair Trading Report and Valuation of test cases and to enable the parties to attempt settlement"
It then goes on to say:
"On or before 22 January 2007 one of the following must be taken:
either
the claimant must notify the court that the whole claim has been settled
or
the claiment or defendant must write to the court requesting an extension of the stay period
or
all the parties must file a completed allocation questionnaire at the court"
The order is dated 18 October, but has been posted on 25 October.
Attached is a sheet which says:
"This order has been made without a hearing under the courts case management powers contained in rule 3 civil proceedings rules. If you object you must within seven days of service of this order, apply to the court to set aside or vary the order under rule 23.(10). You must file with the court and serve the other parties an application that sets out your reason for objection."
What do I do now - any help will be appreciated.
