just an update on whats been happening,, i have just recieved a letter saying my account is being passed to a debt collection agency . i am now aware that they can't do this as my account is in dispute so thanks for the advice MUM OF THREE BOYS.

further updates: i have just received my first offer of £890 on case 1 against the woolwich which i intend to decline as the full amount is £1810... am hoping to get offers on the other two accounts so i can do the same. I was really getting worried after not hearing from my bank but now i have no fear about taking it all the way to court if needed..

watch out woolwich i'm coming for ya!!!

MY letter of rejection has been sent lets hope they hurry and make another offer or i will be seeing them in court ...although the £890 would come in very handy right now i cant just throw the rest away and i will be a lot happier with £1800 when it comes...lol I still haven't heard anything back on my other two accounts with the woolwich but the deadline dates are the same on those so i will not be messing around.

Yes you can, if it is taken before you start your claim (as far as I know). I would PM a Mod to merge your threads, no offence, it will help you and us to keep up to speed on your progress

Further update: my N1 forms are complete and i am ready(i think) to go to the court in the morning and get the ball rolling , real scared though in case i haven't done something right and end up with diddly squat. One bonus for me is that i haven't got to pay my court costs as i am exempt through disability which makes life a lot easier....no cash up front !!!! will keep you posted on how it goes...

Been to court today what a nightmare!!! trying to put in three claims so 9 N1 forms and no help from the gentleman behind the counter!!!
didn't expect it to be all plain sailing but i am now actually really nervous about the whole thing! am sat here with three files full of statements and letters sent and recieved one for each account and am at a loss as to what i have to duplicate to go with the N1 form. I hope this all works out just hope i dont actually have to go to court although i will only i will be a bundle of nerves.

will keep you all updated on how its going..

I'm confused! It read to me that you have filed 3 claims and are now wondering what copies need to be duplicated. Surely you submitted the copies with your claim today? If I have missed the obvious its because I'm having a bad day!

sorry thailand i wasn't very clear . i was going to file three claims today but was sent home with all my files and 9 N1's and told to duplicate x3 anything relevant to my claim. Then return tomorrow to the court with it all done . Do i include every bit of paperwork since the S.A.R - (Subject Access Request) or just the basics of the claim? I am blonde but not normally dumb so i do apologise for scatty brain at the moment but im baffled.

johnni2bad court bundle was huge when i looked at that but was that a second lot put together including every piece of info ready to actually appear in court....im just lost with it all now....

Okay! Don't worry about the bundle stuff at this stage - you may never need it(I have printed this off - but not read it, I'm running on the assumption this is just if you are heading to a hearing). This is what I entered on my mums claim:

3 X N1
3 X Comms between you and Bank (and since I had the statements, I didn't bother with the Data Protection Act/S.A.R - (Subject Access Request) stuff - just did from LPA onwards.
3 X schedule of charges.

Clip them into 3 seperate lots. One for the bank, one for the court and one to be returned for you. (I didn't do 3x everything - just two - it seemed pointless to print a third copy to be returned to me)

I could be corrected on that - but I think its correct!

Thanks thailand, that was what i needed a nuge in the right direction with basic instructions...Have you ever felt like yr brain was going to explode....and the more i read the worse it got...lol

i will now get my claims in order and go back in the morning and try again. i am so glad this site is here with people like you to help out or i would of dropped it all by now..

You don't really need to include all the letters and statements, just the N1 and a schedule of charges.

The majority of people file using moneyclaim where not even the schedule can be included

Yes, although a lot of people don't until asked for them by the bank's solicitors and if you phone MCOL they'll tell you not to and to send them with your AQ, but I suspect that's because they're swamped with claims and could do without the extra work.
