Default Can I do anything? Rascal v Woolwich

I have sent my Subject Access Request to Halifax today and also used to have an account with the Woolwich with a £1000 overdraft limit on it.

I am currently in year 2 of an IVA the Woolwich being one of my creditors although "only" for £1000. I had numerous charges on this account before I entered into my IVA and there's probably a good chance that had I not been charged for all my mistakes I wouldnt have needed to enter into an IVA in the first place.

Am I still entitled to ask for copies of my statement on a closed account with the Woolwich? If so, do I go about it in the same way as I have started with the Halifax - i.e. sending a letter out of the templates section and enclosing the £10 fee giving them 40 days to respond to my request. Should I leave out the bit about wanting to claim the charges back?

I've sent the cheque and letter off to Woolwich so just playing the waiting gamge now. How long did it take everyone else to receive a response?

I sent the letter to the Registrations Department at their head office in Bexleyheath - this was on the advice of a little 'just-out-of-school' clerk in my local branch.

Since last post I've received back list of charges totalling circa.£1400 and sent off preliminary letter to which I had a reply from [Mr x] of Barclays Bank. Now I am ready to send my LBA since the time has lapsed for them to respond proactively. Do I now send all my communication to the guy at Barclays or do I continue with the Woolwich. Also if it gets to Moneyclaim do I claim against Barclays or the Woolwich?

I'm really keen to issue my LBA today - can anyone confirm the answer to my previous question - I am now receiving correspondence from Barclays rather than Woolwich - do I now proceed using the Barclays contact or my original Woolwich one?

To be honest it doesn't really matter, they all end up going the same way, however my personal preference is to claim against the Woolwich, using the address of your local branch.

Some people have used Woolwich, others Barclays.

I agree with closey, it doesn't really matter. I carried on using the Woolwich as I was not told otherwise and I issued the claim against the Woolwich too

I sent off my LBA to Barclays but CC'd the Woolwich. I am just starting to prepare my MCOL form - should I just continue using the Woolwich head office address at Watling Street Bexleyheath for my claim?

They now owe me £1911.76 including 8% interest. My total claim is £2031.76 with costs.

How long did it take for Woolwich to respond to MCOL for those that got that far? I submitted my claim with Halifax last week and they are still to acknowledge it although it was deemed "served" yesterday.
