| | Site Team | Re: The Woolwich?? This may take some creative thinking. I gather from your earlier posts that your account is still open - in which case I would suggest sending your Request for Repayment with the full amount.
In some cases banks are refunding a percentage of the claim as "a goodwill gesture". If they did do this, and of course there is no guarantee they would, it could leave a balance below the £5000 limit.
Of course if they don't, you can then reduce the amount you are asking for when you start the County Court action.
If you then decided to start an action for the remaining balance, it is vital that you did that after the first claim is finished, otherwise the bank would apply to have the actions connected.

| | Site Team The Consumer Action Group | Re: The Woolwich?? Personally, I would split it by charge type - 1 claim for bounced DD's and SO's and another for Cheques and over OD limit.
Be sure not to put them both in at the same time, because the bank would(could) make an application to have them joined.
However....having said that, there has been one person on here recently who claimed nearly 10k in one hit - they bank settled.
I don't think it matters all that much (although that is a personal opinion, and not a recommendation) - as the law is still the law regardless of whether it goes through the small claim track or not.

Anyway the Woolwich sent me a standard letter saying we'll get back to you, which i obviously ignored and now the date has come when they said they would respond by and have sent me another letter basically saying their terms are legal, we signed a contract blah blah and sorry were not happy howeve as a gesture of good will they will refund me £120 of the £6K the owe (damn insult) and as we have an OD limit of £750 and were currently £500 OD they are reducing my OD limit immediately to £200.
Looks like theyre trying to scare me now, just wondering how were going to cope come pay day when we cant use the over draft
