Hello! DVLA CCJ Any advice?

I'm new. I have to say, this website is great!

I have 2 questions if anyone can help;

1. I remember someone posting a great A-Z list of all the categories on this website (eg defaults, CCJs etc) but now I can't find it (it wasn't the A-Z guide above or the Step by Step guide). It was a list posted by one of the moderators in a thread.

2. I recently found out that I had a CCJ awarded against me over 2 years ago. It related to a car I had that wasn't taxed. The tax ran out on the 1st September 2004 and then 2 days later the car was burnt out by vandals. The police arranged for it to be towed away and I forgot all about it. I thought the Insurance Company would have advised the DVLA about the car's destruction but it seems they didn't and consequently it still appeared on the DVLA computer as untaxed 6 months later.

I have a letter from the police confirming that the vehicle was destroyed by vandals on the 3 September 2004 and I was planning to have the judgement set aside.

Is it possible to ask the DVLA to ask the court to set aside the judgment without me having to ask the court to set aside the CCJ (given that they were not aware of the circumstances)?

If not...If I have to apply to the court to have the judgment set aside myself....

If the judge is willing to set aside the case can I approach the DVLA and ask them to drop the case without it having to go to court again?

Yes you can apply for an order to have this set aside.
Theres no harm in you advising the DVLA that you are going to do this and ask if they would have any objections.
In any event its up to you to clearly show why the order should be granted,and if you have clear evidence that it was an injustice then the Judge is likely to favour your case.
I expect the Courts would want you to initiate some dialogue first and try to resolve this before proceeding.
