Question Haifax Credit card Carges for missed payments

Hi, very pleased and greatly relieved to find CAG. I'm a Senior citizen and as a result of a period of illness missed essential payments on my Halifax Credit card.I have found Halifax to be totally unmoveable in the position they take in spite of the fact that I have had other accounts with them since their Building Society days. Strangely they have taken money from my ordinary Current account but not at times which would have cleared any problem.(I would n't have minded this but they seem to have done this to their advantage only) Question which I would greatly appreciate being answered by some kind person. Should I pay off the balance before I commence legal action against them and should I inform them what I propose to do when I clear this balance?

Its up to you whether or not to clear the balance, it will make no difference to the claim. If you can afford to clear the balance it might be a good idea rather than paying interest on it.

Hi,
Very much appreciate your kind reply.
I a bit puzzled as how you can go to court to reclaim charges when the
balance on your credit card account shows a net debt. Is this possible,
that's basically why I asked whether one should pay off these charges first before court action.
I read about members claiming interest at 8% on refunded charges,but surely if these charges are deemed invalid from the date of imposition
then the high subsequent consequential interest should also be invalid.
(Or have I missed something when I have been reading around your invaluable site}

Jack please have a good read of the FAQs and other related self help material to understand the processes and laws involved. Charges for late payment etc can be claimed back no matter what the reason was however any payments on a credit card still need to be paid as per usual.
