Default Terrified but determined!!

Hello all,

Have registered a couple of nights ago and only now working out how to post a new thread so i guess it's going to be a long and tiring day!

Am claiming £820 from Barclays and have gone through the usual stages. They offered me £350 - I nearly accepted but after studying my statements and seeing that they charged me £30 per pday for three consecutive days for being £4 over my limit I have decided to go all the way.

I am about to use moneyclaim and have tried to read as much info as possible but there is so much to get through I think my head is going to explode. I am going to bite the bullet and go for it. I am trying to keep a positive frame of mind but I just get visions of standing in a court room facing the big fat cats of bank managers laughing me out of the court room.

Please can somebody give me a little boost of 'postive mental attittude' to get me through the next stage.

First of all well done for getting this far. Have you followed the correct process to date e.g LBA etc? If so then go ahead and claim on moneyclaim. Dont forget if you are in reciept of any benefits then file directly at local court using N1. I have a template of this if you need it. Just PM me.
The banks are not going to go to court. They would have to declare their alleged actual loss to the judge, which would never happen so they may pay out on recipet of the court papers. However some file a defence, and although they have no inclination to actual arrive at court to defend, its a stalling tactic in the hope you will "melt" and give in. Dont!! You will get your money

go for it ,it's your money they unlawfully took from you.judges seem to be genuinely trying to make you feel as comfy as poss if you ever get to court,read the threads and see how many are being settled before court,plus you have 80,000 new friends on this site who will help you.good luck.

It's nice to know there's help out there.
I orignally used the templates of the 'Which' website before I got to know about this site and my latest letter to bank stated I was not willing to accept their part offer and that unless they offered full amount in 7 days I would be procceding with court action.
Does think sound right???
I actually telephoned them after 8 days to see if they were going to responsd to my letter and was told 'NO'.
So here goes....
