Default So Far, so good!!

Just thought I'd update with what has happened so far. At the beginning of September I sent a letter requesting all the info on charges that I incured over 6 years. 1 Week later, I got a letter saying that they could do this, but it would cost me £5 & did I agree to the charge........ (yet another charge!!)

Anyway, sent a letter saying yes I did agree, then 1 week later I received 6 years worth of statements. I went through them with a fine tooth comb and found that I had accrued £1254 in bank charges. (It was amazing to see that in 6 years there charges had increased by £11)

So on the 28th September, I sent off my letter by special delivery with copies of the bank statements with charges and asked that I be reimbursed for the bank charges of £1254 + the £5 charge to obtain the statements so a total of £1259. 2 Days later I received a letter saying that they had received my letter and it had been passed onto the relevent person and they returned my original statement copies. The day after that I received another letter saying that it was being looked into and they would get back to me within 14 days (as requested in the letter)
Well, I didn't expect it so soon but I got a call from the Halifax saying that they were willing to pay back about £800 as a good will gesture but they wouldn't pay anymore. I have asked for it to be put into writing to me and I'm just waiting for there letter.

This is where I need some more advice. Do I accept the amount that they are offering now and still try for the rest of the money or do I reject this offer and keep trying for the whole amount?? I know you have said in the past that it is all about how far you are willing to take this and I suppose how much bottle you have.
I want to push this all the way, but now they have offered a good will gesture I need to know that if I accept this offer that I won't jepordise getting the rest of the money.

Thanks for all the advice so far though, it has been really educational and I have actually enjoyed trying to get my money back (and it feels good knowing that I am almost nearly there getting it back!!!)

Hi, LG32, welcome.

First, may I suggest you post yourself a NEW THREAD on the Halifax forum. You'll be among friends there (not that the rest of us aren't friends! but you'll be with peeps who know how Halifax works, as opposed to any other bank), they can offer you advice and/or encouragement as required.

You'll also find it fascinating and helpful to read round a few of their threads. It'll give you the heads up on what to expect.

As to the q. you have posed above, the choice is yours. You could try saying 'thank you, I'll have the £800 in part settlement of the whole claim, but I intend to take this all the way, to court if need be, to get the refund of all the charges, plus costs and interest'.

Don't worry about jeopordising your claim, just make sure that you stress that it's ONLY accepted in PART SETTLEMENT. If you show them you mean business they'll have to play ball eventually.

ps You don't seem to have taken into account the amount of interest you are entitled to on top of the £1259. You are aware that this will add up to quite a large amount aren't you?
