Hello, do I have any kind of case here? Firstly, hello everyone, this is my first post, so here's the obligatory greeting.
My case is as follows:
About two years ago I moved in with my girlfriend and we set up a joint bank account to pay our bills from. We set this up with HSBC, who my girlfriend was already with. As a matter of convenience I changed over to HSBS at the same time and signed up for a current account and a credit card. This was all fine up until a few months ago.
The issue relates to the joint account and my credit card. We elected not to have an overdraft at all on the joint card as our bills are pretty fixed and we were putting more than enough money in to cover the bills and make some savings. The problem is that there was an administrative error when setting up the direct debit to my credit card and it was set to take the payments from the joint account rather than my current account.
As a result of this, our account went overdrawn and we were fined £100 for this. Over the last 2 years, this has continued and as we get more overdrawn, the fines have got bigger. The biggest problem is that we were not notified of this until we were overdrawn by £400, having been fined over £1500.
I have already been to the bank and spoken to them about it, but they claim that it is my fault for not checking the statements carefully enough. The real dispute is the administrative error itself. I am absolutely adamant that I did not sign any paperwork to tranfer money from the joint account and this is where the dispute lies.
