Hi,

I am in the process of waiting for Abbey to give me the details of charges made to my account over the past 6 years. Its taken 6 weeks to get the right form as their complaints department seem to take as long as possible in replying to you.

I have already sent the first letter asking for a complete refund back in early June 06, this also gave them the first indication I would use court action. I have to say I sent this letter from another site as I did not know about this site then.

As soon as I get the information I need (which cost me £10!!) from Abbey, do I send another letter with the amount + interest again threatening legal action or go straight to court action?

Anyone help and who else has dealt with Abbey?

I think that once you know the amount of your claim you could send the LBA amended to suit and in it refer to your previous letter. Then after 14 days submit a claim at moneyclaim

Hi Nick, it's important that YOU set the agenda. You do not need to wait for any responses from Abbey. The point of the first two letters is to give plenty of notice that they have to give you your money back. If they choose to ignore them, that's their problem. When you start your court action, you'll be able to say that they had plenty of opportunity o deal with the matter. The one thing they cannot ignore is a summons.

If I were you, I would wait for your Data Protection Act information to arrive and then start your court claim straight away.
