Default International Parcel Damage Claim

Hi All, I hope someone can advice me before i go insane!. I received a parcel back in October from USA, it was guitar i purchased from ebay. The guitar turned up damaged and i straight away infromed the seller who told me he would get in touch with USPS and report the damage and claim from them. I am still waiting to be paid out for this and USPS have still not contacted me and neither has Parcelforce for that matter. I have made numerous calls to Parcelforce who have said bluntly that the sender has to deal with it!. He assures me he has and is waiting fot USPS to contact Parcelforce to contact me (you get the picture now). This hasn't happened and now after calling USPS myself they have said the case is closed because they did not receive a damage report from Parcelforce! Parcelforce have no records of this claim so basically i have a broken guitar and a hole in my wallet... Can anybody advise me as to what i can do or any legal action i may be able to get to help me get all this sorted?... I would really appreciate it as this situation is making me go mad!!! It seems a breakdown in communication between the two poastal services has cost me dearly. Because of the time scale that has passed it seems i have lost any rights i had, this seems unfair as i did all i could from the start and other people being slack has cost me.

It would be difficult to take legal action against the seller as they are based in the USA.

What is the value and how did you pay?

The item was £225 and postage £70 then on top of that i paid a customs charge to Parcelforce of £71. The item and postage was paid by Paypal through my credit card and the custom charge was paid by credit card in person at the depot.

It's too late to take action with Paypal but as the total transaction was over £100 your credit card provider are equally liable, so I would contact them if the seller is being uncooperative and ask them to take action.

I don't think you have any basis for a refund of the customs fee but would advise you to speak to HMRC about this and see what they say - 0845 010 9000.
