Ah, the old "apparently"...
There is no "loophole", there is not "apparently".
What there is is a test case, during which the banks no longer have teo respond within the usual deadlines, effectively putting cases on hold for the foreseeable future. Likewise, the FOS is also not dealing with bank charges cases, filing them away until the resolution of the test case.
Tell your friend to go back to the cashier and advise that he CAN NOT refuse to give him his information, as long as the request is made under the Data Protection Act, as he is breaking the law by doing so.
