Default default notices/ old debts/ mortgage application

hello. im new on here. have loads of questions and will try and be clear. in a few months i hope to apply for my first mortgage but am hardly a spring chicken. today i received my credit reports from the three CRA's. not looking good. i have three defaults on credit cards, these all date back to default notices being issued over 4 years ago..if i wait 22months my credit file will be clear but am looking to apply for mortgage in November this year/ 2007. we all get into difficulties and none of us intend to not repay credit card debts but ,circumstances sometimes beat us. i am thinking of writing to the original issuer of credit cards, BARCLAYCARD, to see if i ask nicely if they will remove default notice or go down the line of asking for copies of default notices, but who do i ask? the original issuer, BARCLAYCARD, or the debt collection company that now handles the debt? one of them is moorcroft debt, WHOM I FIND VERY OFFENSIVE! also i have a long standing debt going back to 1994, originally with UNIVERSAL CREDIT, but now with PARAGON PERSONAL FINANCE, who are very aggressive. it was for £4000 ive paid back over £7.500, i really don't like these PARAGON people, and am thinking of asking for original copy of agreement...what is anyone's advice, they just wont go away and have added over £400 in SUNDRY CHARGES, to occasionally reply to my letters, despite being informed that i will only communicate in writing. Any advice on all of the above would be wonderful. i really need to start getting things moving and was devastated when i still seen these three default notices on my credit reports. thanks 4 reading.

I not an expert but I believe that as is with the bank charges, the debt you owe to Paragon is no longer recoverable in court. It would be up to you if you continued pay or not. I belive that you have paid enough if its over £7500.

I would defo do CCA requests for the agreements. Have a good read in the debt and dca forums, where loads of us have dealt with or are dealing with DCA's. DCA's rarely seem to have the correct documents to support their collections and seem to completely ignore all debt collection guidence. Start a new thread in the Debt/DCA forum where you will get plenty of support in your fight. The only trouble is that these things can take time depending how you want to proceed. So you might struggle to get everything clear by Novemeber. Given the amount you have already paid back to paragon if they then have no agreement either you would be in a good position to negotiate with them a low full and final settlement payment, in which you could try to get them to agree to clear the default as well. Good luck.

BTW I'm no expert just using info I gathered from experience and from the great guys who post on here
Sent 12 CCA's(hubbies and mine), all but 1 now in criminal defaultl, only 1 provided agreement so far accepted low monthly pay offer but going to claim charges/PPI as well to bring balance down 2 have admitted debt unenforecable.Unfortunate ly keep getting passed over to new DCA's who have to get the "bog off no CCA" letter. Preparing FOS complaints on all of them.

hi. thanks for that... i think i will write to Barclaycard requesting the copies of the original CCA agreement, these cards were originally issued in 1993 for the barclaycard visa, and 1995 for the Barclaycard master card. the defaults, according to my credit file were issued on 30/04/03. im just a little confused in respect of the fact that both these debts are in the hands of DCA's, i am paying small amounts monthly to these agencies, but if Barclaycard cant produce the copy of the CCA, is that it? i no longer have to pay these agencies?
As for the paragon personal finance loan, which was originally taken out through UNIVERSAL CREDIT in 1994, 13years ago for £4000, and i have been on reduced payments for at least 6 years and paid back so far approx £7500. if they cannot supply copy of original loan agreement with universal credit. do i simply say to them that the amount they say i still owe, which is over £3000, is unenforceable and it goes away? is this the case? how long am i liable to keep paying them after i have paid back the original sum borrowed? hope this is all clear, hope someone can keep things simple for me. thanks.
