coil fault and warranty

Hi can anyone help? I purchased a clio 04 plate in Dec06 from a Dealer, When the coil went the other day I contacted them to ask if I am covered and was advised yes, after taking my car to a garage they found I didnt have a warrabty at all so kept my car until I borrowed the 123.38 to pay for the work. The dealer I bought the car from is refusing to pay and said the coil wouldnt have been covered on a warranty as it could have gone at any time. Is this true? thanks

So did they do the work without your authority? Did they give you a price first & gain your authority? If not, I wouldn't have paid. Not sure about warranty on a coil pack - you would need to contact the head office to confirm this.
Did you not get a years warranty from the dealer when you bought it?

I took the car there as I had been there many times before and the car dealer had an account with them and rented part of the garage to sell his cars there. The owner of the garage knew I had only had the car since Dec06 so assumed there was a warranty with it. It was only after it had been repaird and he tried to claim from the warranty that he couldnt find it registered with anyone. The dealer I bought the car from sold me a Corsa sxi in October 06, it was a pile of junk and as I kept having faults with it and was back and forth the garage for repair every few days he agreed to take it back and sell me another car. He wouldnt give me my money back instead. I then bought my Clio instead and although I had a warranty for 1 year with the Corsa, when I bought the Clio instead he took the warranty off me as the Clio was an 04 plate and had a remaining 3 months on the original warranty with renault. I have found an ad in the thompson local directory 2006/07 stating they give a free 1 year warranty with EVERY car sold so he is surely breaking the law by refusing me one. I phoned consumer council and they advised I need to claim the money back from Carlisle finance as car is on hp but surely I have a right to have a warranty from the dealer too as per his advert. Sorry this is such an ongoing saga

I know it is too late, but you shouldn't have paid the bill. They did not gain your authority for the work or give you a cost before they carried out the work. They should have checked the warranty first, not after they had repaired it. At the moment the 1yr warranty is a separate issue. I would write to the garage, stating the facts, saying you did not give authority for the work to be carried out and you want an immediate refund.

However, unless he has explicitly stated he was paying under duress, has he not now accepted the bill? Basically, the work was done without authority, and as such the garage cannot force a payment. However, the OP has then agreed to pay, in legal terms - the only question is whether he paid under duress.
