Red face Close Motor Finance closed account reclaiming charges

My partner paid off Close Motor Finance when he sold his bike this year & while I was looking at reclaiming bank charges, we realised he'd been charged a total of £176 for Default letters etc when the bank had returned the S/Os.

Do not want to send off S.A.R - (Subject Access Request) as haven't got the spare cash at the mo, but have a Transaction History sent out by Close Motor Finance on 27th Feb 06 which shows the charges etc. I know all the payments after that were made on time until it the bike was sold, so am going ahead with Prelim letter adapted from that for banks. Am including spreadsheet & charging interest at the rate of the agreement until close of the account.

no need to it will be a standard fob off letter - send them a LBA then when they still refuse start court proceedure etc - tho this will cost you and if your skint you should think about saving for this...also sending DSAR would be a good idea as you argue in court on the grounds that there has been no manual intervention etc to warrent the charges as computer generated etc...just a thought...thought you could try writing to get a responce to this particular question.

Hi,
Has anyone got a template or a letter requesting a breakdown of the charges. As you can see, I've been sent the usual fob off letter. There is one charge I'm not sure of being able to reclaim as it was for a home visit they charged £50 for despite also sending 2 letters (totalling £35.50) just before & on the same day as the visit. I know they'll be able to 'explain' this away with travel costs etc, but I would hope to be able to dispute the necessity of it. Not sure DSAR would be necessary as I've had statements of charges from CMF so am aware of what's been charged where. Just thinking of trying to get them to do the impossible and explain why they charge so much.

However, if not this one, I will be seeking to claim back the other charges - £10 for a phone call!!! Preparing to send LBA when 14 days are up.

Can anyone tell me if it's 14 days or 14 working days?

Been concentrating on some other matters lately, so have let this one slide down the list of priorities.

So, to update:
Sent LBA and received no response.

Am preparing to fill in court forms but have a couple of similar cases where the charges are with finance companies/service providers who haven't responded. I'm going to try to get them filled in over the weekend, but am thinking of sending them copies of my filled in court forms & telling them they will be filed in 14 days if they don't respond favourably. Most of these claims are for smaller amounts that wouldn't justify their costs if I took them to court. Obviously it'd be great to get a judgement against them in court, but I think they'd be unlikely to let it get there anyway.

Has anyone else done this?
