Hi All

I have had major problems with Logbook Loans as discussed in Logbook Loans - Can anyone help??? Thread.

Because of my problems I have posted on a few sites and somebody else who I have been corrisponding with is also having a real nightmare. I told her about the site and she has tried to register but is having problems doing so. She is battered and bruised and on verge of giving up so I said I would ask advice on her behalf because she really has been stiched up and everyone been so helpfull to me. Spent all of last night trying to help her but i wasn't sure about few things.

She is on the other side in a way, in that she doesn't owe Logbook Loans any money but she bought a car in good faith not knowing the previous owner had taken out a loan with them.

Out of the blue a balliff litterally ran her husband off the road after balliff 'spotted' him driving along in the car, he pulled up very suddenly in front of him. The balliff came to the window of car, did not identify himself and snached the keys from ignition. Her husband called 999 in a panic and police did not come out but spoke on phone with both him and the balliff. Police told her husband that balliff needed a warrant otherwise he couldn't take it. Balliff then told police there was a warrant but it was back at the office and he would fax it to the police (he had previously said he didn't need one - don't know if 1/3 applies?. Police gave him permission to take the car, balliff laughed in their faces and started whistling as he loaded car and went.

This only happened on Friday, she has been trawling the internet all weekend and is exhaused, she has 2 small children and has not slept since it happened, I am now in telephone contact with her.

Where does she stand? I know that as an innocent purchaser she is entitled to car under consumer credit act. But as we all know these cowboys don't play by the rules and I am scared my advice is going to come too late.

Situation at the moment is that a policeman came around today and said he wasn't sure what will happen but he was back on duty on wednesday and would look into it!!!!!!! He said previous owner could be done for deception but i know thats not the case.

I know she needs to get legal advice and quick but she really is shattered and can't think straight.

Anyone know what I can tell her to reassure her, or do you think Logbook loans are in the clear?????

P.s Policeman who came was a community officer and didn't seem to know much about any of it - I couldn't believe it considering they called 999.

Police has spoken to balliff and told them they where a 'proper' firm because he had looked on their website???!! - Gemini International private balliffs?? Balliff then changed his mind and said they didn't have a court order as such but relevant documents??? He was faxing them over to policeman on Wednesday.

This sounds very irresonsable ofthe police to ell the Baliff on the phone he could take the car without seeing any sort of documents. Did they get any sort of reciept or something like that for the car being removed. Was the car bought provate or through a trader

I had a forum user "liamarkfin" who had suffered a similar loss of his car by Lbl's so called bailiffs (repossessed for the same reason), his vehicle was subject to a loan taken out by using apparently his ID and with log book loans albeit not by himself thats scary stuff.:o

His vehicle value was approx £8,500 after advice from myself he is at last (a week ago) well on his way to getting his car back and more?.

I know it's a different situation but i can see this going one way only at present but can you advise the below please.

What is the age of the car? and approx value? please meggyweggy, no i dont want proof just some figures on here's fine.

Ok thats fair enough but here's the probable answer,the police will probably take the easy option out as no one apparently got hurt (Sustained injuries either way) disregarding feelings of course.

Depending on the value & age of the vehicle and whether they owned the vehicle outright i suspect the answer will be, it is the responsibility of the purchaser to avail themselves of any information held on the potential purchase namely a vehicle.

Various methods are now available to the general public to check a vehicles history & any surety and/or lien upon the vehicle, they also offer insurance on there information supplied against such inaccuracies, and most if not all cover all eventualities including private purchases.

In plain english "Was an HPI or equivalent search report taken out on the vehicle" obviously not in this case or? bought from a dealer or on finance then thats where the responsibility lies, but there are time constraints of course.

Footnote: I had this type of thing happen to me, when someone impersonating a bailiff (Under contract with LBL Ltd) threw a letter at 6am over my garden fence and very quickly made off in vehicle, didn't find it funny when 20 mins later i pulled up at his next job and removed his keys from his vehicle, i then went out for the day he didn't find it very funny but the police did later on that evening!.

Will these guys stop at nothing? I have to be honest I thought I had a bad time with them last year but my problems seem to pale in comparison to others on here?
Nellie - What I can't understand is - why did your friends' husband let the bailiff take the car after all the Police told her husband that balliff needed a warrant otherwise he couldn't take it? When did they find out that LBL were involved and have they had the warrent yet? Finally did they buy privately and was an HPI check carried out.

Balliff has faxed the police a document stamped by the high court London, its not a court order unsure what it is - police sending her a copy.

I suspect this is either a fake or some other document, maybe when they register interest in the car. Why the hell would they go to high court, i smell a rat!!!

Get that document checked out ok as to it's authenticity? as a bill of sale/lien,proves one thing though they have been reading/watching this forum and we are aware who you are!.

Looks like there doing a en mass application in the high court to enforce there rights over the numerous bill's of sale/lien's? message to LBL Ltd yer too late Armageddon is upon you!.

Yes VJR they are watching this forum without a doubt. My car has been repossessed so do you think i can assume they have had the bill of sale enforced in high court cos i think they know who i am, had details i didn't give them etc I would have thought i would receive something from the court though to inform me???? I have had a house nearly repossesed before and i recieved letters from the local county courts well in advance of hearing so i could attend, i take it the same doesn't apply to bill of sale agreements
