Default Need Advice 8 month old car- problems

Hi there, I need a bit of advice as Im getting nowhere with ford.

Basically we bought a new Focus Cabriolet in March 08, around early october it was sent away to a specialist ford repair center to have the roof adjusted as it developed wind noise on the driver side door.

Since weve had it back weve had nothing but problems, the engine warning light comes on and you lose all the electrics on the dashboard, radio, air con, occasionally when this happens the engine cuts out al together, this happens within a couple of days of teh car being returned to us.

Its now been into our Local ford garage where we bought it from 6 times, they either say they cant find a fault or when they do get a fault code they replace whatever part only then for the fault to come back within a few days.

In the last 3 months weve used this vehicle for about 14 days, the rest of the time its been in the garage or sat on the drive waiting for them to look at it.

Weve pushed and pushed for a replacement vehicle as as far we are concerned, they have had more than enough opportunity to fix the car, it has only done 3500 miles, each month we are paying out nearly £300 for a car we arent getting use out of, no hire car or coutesy car has been provided.

Ive written to ford credit who basically fob me off and say its being dealt with under warranty, the garage say its not their decision on a replacement car and its down to ford Head office and ford customer relationship center basically say its upto the dealer to aproach ford on our behalf and basically say were sorry but theres nothing they can do.

We really have lost all faith in this car, its dangerous aswell as when it cuts out you lsoe the headlights and trvelling at night could cause an accident.

I just want an end to this now, either a new replacement vehicle or my money back

What I really want to know is where do we go from here? and who is my contract with? the dealer? or because its on finance, the finance company?

Did you have a loan to purchase the car or is it hire purchase.

If the latter then the car is the joint responsibily of the finance company as they actually own it not you.

its hire purchase, does that mean that if legal proceedings start it should be against the credit company, not the garage?

Your contract for the supply of the vehicle is with the dealer, but hp co. owns it.
You need to write to the dealer saying you want to reject the car due to faults under SOGA ( not fit for purpose etc. ) and copy the HP company, give them 7 days to respond or you will take legal action.
Do everything in writing from now on. If you do reject it you should not use it from that point and ideally return it them. This might make them sort it out properly, usually focuses their actions.
