Default Help faulty new Mazda RX8 any ideas

HI All,

Im new to the site and looking for any advice as i am now stuck.

I bought a new Mazda RX8 in Jan 08 and after 7 weeks it went faulty for the first time. Since then it has spent half its life in the garage being repaired for one thing or another!

I attempted to reject the car on the 4 th time it broke down as it is clearly not of satisfactory quality that any reasonable person would expect. Consumer Direct says i am entitled to a refund / replacement but i am not having much look getting mazad to agree. Infact they have refused and have offered me 2 free services!

The car has now been sat in the dealers (as i refuse to collect) for nearly 2 months while i continue to pay. I have referred it to the Financial Ombudsman but they take about 9 months, all the time i will be paying for the car but not actually having it!

I am unable to afford a solictor to take them to court.
I have tried the SMMT who are not interested, i have tried RMIF to no avail.

Anyone any ideas as it appears Mazda can get away with selling me a crap car and not doing anything about dispite the law!

HELP

I pressume when you say mazda is not interested in dealing with it you mean the dealer, not the car maker? your contract is with the dealer!
You need to put all that has happened, what has gone wrong with times dates etc. in a letter to the dealer formally rejecting the car and that you want your money refunded. was it bought on HP, if so the HP company owns the car and they acn help put it right but wont help you get your money back, not in their interest.
Check SOGA that will let yu know your rights and you can quote them to the dealer.

If it is HP then the company is joint and severally liable so that mean if you get not joy with one then you should tell the other.

You don't need a solicitor to take them to court, you can get the forms from the court, the small claims starts at £30

HI,

Thanks, I have written an offical rejection letter to Mazda Credit but they are not willing to do anything, they are also not admitting responsibility. Unfortunately i cannot go to small claims court as i am now looking for a about £8000 refunded.

Problems with car are as follows,

Check Engine Light kept coming on
Car misfiring on start up
Car kangarooring down the street
Car cut out when idling at traffic lights
Car cut out when turning into a car park
Started car and then cut out straight away, would not turn over had to get it towed!

What they have done so far,
1. Cleared CEL and told me know fault
2. Changed plugs and coils as they did not know what fault was
3. Changed PCM
4. Advised me it need wiring loom replaced - but did not do advised they had done something else with wiring.

Basically it appears they havent got a clue.

Why have you written to Mazda credit? are they the dealer you bought the car from! Your Dispute is with the dealer who supplied the car not who provided the finance!
What sort of finance agrrement is it: HP, car loan, lease purcahse?
as said before if HP the belongs to the credit company not you, similar with lease purcahse.
You need to clarify.
