Default tifo v Moorcroft (UU)

Situation is as follows :

I was paying United Utilities £15 per month for my water bill.

In September 2007, they passed the account to Moorcroft for no reason (payments were up to date) and won't deal with me.

I have been sending a cheque to Moorcroft every month and asking for bank details so i can set up a standing order to them. They've been ignoring this.

I stopped payment and they gave me the bank details. I set up a standing order. First time it did not go through so i set it up again. This means they are now due £30 which i have offered.

They're threatening legal action with costs of £125 to issue the claim and solicitors fee of £180, total £305.

They're insisting a water bill is a priority debt and i've told them it's not.

Amount outstanding to UU is £130 in total.

Advice?

I would write to tell them they are being unreasonable as you are willing to make the payments. I seriously wouldn't waste time talking to them.

Makr the payments regardless of whether they accept them or not. The only DCA i now pay is Moorcroft. I pay through the link on their website which takes you to the Alliance & Leicester site, which is a secure way to make payments. You have to sign up initially (at no cost). Once you make your payment you receive an email to confirm the payment has been made which is useful to keep. Prior to using this method i paid by postal order - always keep the receipts - it's amazing how often they 'hadn't received' them until i sent a copy of the receipt

If you are making payments and they accept them, it will be difficult for them to take further action as they will look very unreasonable.

They sent me a paying in book. told them to stuff it and just sent cheques, until they defaulted on the CCA request now I dont pay them anything.

I would write and ask for a copy of their formal complaints procedure. I would then make 2 seperate complaints - 1 about the rude staff (i would ask for an apology) and 2 about the palava with the acc.

In the meantime, continue with your payments, they haven't got a leg to stand on then.

Also, i would ask for a statement of account, so you can see exactly what payments you've made against the account. All these different letters just let them know you are on the ball and won't be bullied or walked over.
