Hi All,
Bit of advice needed here please, had a long telephone conversation with YW today regarding the outstanding balance. In a nutshell, was asked to clear outstanding bill, explained could'nt afford to but could reinstate original £50 per month and pay extra when available (originally paying through Rockford at this amount) totally refused my offer and insisted 3 times that as minimum otherwise taking to court. Insisted even after means test that not enough funds and offered to pay £150 straight away to catch up and then £50 per month, still refused my offer, I then insisted that I will continue to pay the £50 per month to show I am paying the debt and quartely bill but as they would not accept this as an agreement then they would continue with the legal side at which point I said I would take my chance at the court if it was to go that way BUT I still maintained I will still pay regulaly via my debit card as YW refuse to set up a standing order.
I explained my situation and the fact that i have also changed banks and therefore apart from 1 other company I have to set up a regular payment with, YW is the only company NOT to come on board. Everybody else has literaly been grateful for contacting them to keep everything going.

Now back to the top, after the conversation was over, I requested a full copy of the conversation I had just had so that I can take this with me should it go to court, I just need to know what (if any) specific rights I have to get the copy, ie the banks its the Subject Access Request but what is it for personal data/conversations people have with a 3rd party? it's just so I can put it in my letter to the complaints department for a request, as the customer services person stated that I may be charged for the copy and I beleive that is an encroachment on my CIVIL RIGHTS perhaps I have just answered my own question?

I normally post on the banks and PPI threads but this as got me boiling.

You can send an S.A.R - (Subject Access Request) for all data they hold on you, but also specify that you want a copy of this conversation, giving time and date of call and name (if known) of the Customer Service agent

They may say the call was not recorded, which may be true, but there's no way of knowing.

There's a Data Protection Act Subject Access Request letter here:

but I don't think it's that I'm after, it's is there any legal jargon regarding getting the tape released to me so that I could use it in any action I may need to use as a defence regarding the conversation and my offer.

sorry if it sounds like I'm disregarding your advice, I'm not after charges etc and I don't see how I could tweek the letter without rewriting altogether.

What Micheal is saying is correct the issuing of a Subject Access Request is for any data that is held by them about you ..... this includes any taped conversations all you need to do is amend the Subject Access Request to suit
