Default Returning a phone

Hi everyone, never really thought that such a place exists. I can see it has helped a lot of people, hopefully it will give me some confidence.

I bought a brand new phone today, a BlackBerry, from T-Mobile. I've been with them for 4 years now, quite happy with them and planning to stay.
However, it turned out that this phone is far more complicated than I expected (nothing like Nokia or Samsung, or SE). I can't find the software I need in order to make most of that phone (ICQ, MSN, etc.) and some other software I find essential. Baiscally - it doesn't do what I expected it to do. Can I return that phone? Costs me about 50-ish a month, so if it doesn't do the job I need to change it.

Is there any policy I could use? 7-day returns or something? I looked all over the T-Mobile site, however, unlike the US branch (they have 20-day returns policy), I couldn't find anything.
Oh, the phone is still with its screen protector, nothing missing or damaged in any way.

I'm quite happy to swap the phone for another suitable at the same price.

Any help would be handy. Thanks.

I'm no expert on these matters but I seem to remember that I had a 14-day cooling-off period when I got phones from Onestopphoneshop (an online retailer). Mine have always been connected to Orange and I did decide to return one last year as it happens. I was billed for 5 days line rental (despite never even breaking the seal on the box) but this was infinitely preferable to keeping it. However, I know I could have opened and used it and still returned it.

Did you buy it online or at a shop? I expect there will be differences between the two as obviously buying online invokes the distance selling rules. I'm sure someone will be along to give you the proper facts soon.

Go back quickly and explain your problem, if you simply want to switch to a different handset, then providing you do it within the week or so, you should be OK. Just act helpless, if you go in stroppy they do their best to keep you stranded!

Well, it turned out that they were quite understanding. Didn't give me the N95 but well, could be worse.

sorry for the intrusion, but after reading your posts, i was about to add that usually phone shops give you a period for refund or exchange the local o2 shop did for my partner when she purchased a phone and ,then realised the memory was dreadful. one quick return to the store the day after and she came away with a much better phone. it's nice when you can say that some stores do actually try to be helpful.
