I have been reading through the posts and I got a letter of Wescot for Sky and BT, I sent a request of for CCA for both, this morning I got a letter back saying

'Dear Miss xxxx

Following you request for a copy of the opening agreement and the deed of assignment.

We can confirm under the terms of the Consumer Credit Act (Exempt Agreements) Order 1989, article 3(1)(a) these accounts are not regulated by the Consumer Credit Act and is enforceable. The deed will be available from our client.

The accounts have been placed on hold for a period of 7 days pending your payment proposals which are required by return.'

I just thought it would be worth a try for a CCA request, I will have to write them a letter and do a budget planner, as both accounts come to over £300, which I cannot afford to pay right now.

Just finished some preening!

They are correct, no credit is involved here so you have effectively a 'Service Contract' with BT and SKY, so no formal requirement for Default Notices and the like. They give you a set period to pay, and if you do not, services are restricted or removed and the payment problems are marked on your credit record.

You don;t say whether the high charges could have been in error, of it you actually incurred them, if you did then the only solution is to pay up, or apologise and say you'll arrange to clear the balance in 3 monthly instalments (which will be over and above any other bills they send you). If there ARE errors though, you can insist on them being corrected, paying only the charges you do not dispute.

thanks buzby, the sky charges are correct but the bt one has had charges to it. i am not disputing the debt, i owe it and i will contact them to make a payment arrangement, thanks for clarifying everything.

WAIT! Just before you rush off and part with your hard-earned.... do Sky charge you an 'Invoice Charge' ? If so, then this should be challenged, just because you don't want to pay them by DD is no reason to pay £4-odd extra a month. Challenge them if they do!
