Default Vodafone CCA?

Hiya

Got myself in a bit of a pickle around september and defaulted on my mobile, anyway they have since got Wesccot DCA involved and they are threatening the usual. Now the big confusion is if i send out the standard letter in the archive requesting a copy of my CCA will this apply?
I'm pretty sure they won't have one as the contract was with singlepoint before the buy out so was hoping the debt would then be written off.
I read through Dayglo's thread but couldn't get a difinitive answer as vodafone seem to apply the consumer credit act when it suits them then say it doesn't apply again when it suits!

Oh Vodafone have just given me a great laugh.

I wrote requesting Credit Agreement they have written back you didn't buy the phone through us please contact Dial-a-phone Ltd. Oh and please call us to discuss the balance on the account.

Letter going back highlighting their obligation under S189 to provide it whether or not they are the original creditor.

Unfortunately the 12 working days doesn't expire until 1st March 2007. So "the accounts on hold and remove your default notice", will have to wait until after 12 days is up.

Do you want a copy of the template I used?

That would be good yeah, i have the one templated on here so if yours is better cool.
So if the DRA can't produce a CCA is that it then? Debt wiped off?

Nope - as has been covered by many threads here, a mobile phone contract is for telephone service, NOT credit, therefore you just waste a letter and a stamp.

You can request your Service Agreement, but they don't have to provide it.

What's your objective here? Is is to get the default removed? I have a similar scenario with my daughter. See http://www.consumeractiongroup.co.uk...t-has-got.html

We couldn't see much we could do other than dispute until proof provided in form of invoices. Proof of use of the service is easy for phone company to prove. They do seem quick off the mark at defaulting and probably do it after the period of notice on the default irrespective of what happens in that period of notice. Wish I knew their exact dates of when they did what.

If it is default removal you are after the SurlyBonds approach looks OK to me. I think you will find the details in the Legalities forum.
