Since 24th January 2007 my isp which is Be unlimited have had outages at my exchange for a total of 37 hours. My isp is LLU(Local loop unbundled) so they do not use BT's equipment in the exchange.

I asked for a partial refund of the time lost but only got told until your service is down for 120 hours consecutively I will not get a refund.

Surely any loss of service not down to me is not getting what i pay for.

Anything I can do here?

Patience is a virtue.

Do Be offer any sort of service level agreement? Are there any contractual terms limiting their liability? Was this one long outage or a series of brief outages?

Seperate outages and there T&C do claim only after 5 days. But this is poor and wanted to know if they could do this?

I suspect it would be a bit of a hard slog. You've lost about 6-7% of the service you paid for, you'd need to prove it was Be's fault on a balance of probabilities, and all you'd get is a few % of your monthly fee. If it was a longer outage you'd have more of a case, but this although annoying is probably not worth pursuing.
