Default Vodafone/Carphone Warehouse Vodafone lost my number

My contract was originally with Vodafone.

I upgraded in Carphone Warehouse and didn’t realise that I started a contract with Carphone Warehouse Vodafone.

The contract was under my name, but my cousin used the phone overseas on holiday and business trip.

Originally, I had disabled the voicemail function. It seems to have been turned on automatically overseas. It was hardly used since they had another phone for their use.

DECEMBER/JANUARY
The total bill came to £300.00, which we disputed.

FEBRUARY/MARCH/APRIL
Finally, we ended up with a CCJ, we did pay up in CASH in a Carphone Warehouse outlet.

We were told afterwards that we have to pay another £50.00 in order for the service to be re-started. We told them to forget it.

MAY/JUNE

My cousin realised that she would prefer to have that phone number and decided to pay for the £50.00 and have it transferred to another Network.

At this time we had no knowledge of Vodafone taking over the Carphone Warehouse Vodafone and the company managed to lose all the details of the account.

The questions now becomes:

As I have or will have the details of paying for the last year for this phone without anything to show for the service and basically annoyed at paying for that £300.00, do I have recourse to dispute the charges with my card company and bank?

I cannot get the £300.00 back since I did pay in cash, but the £1200 via electronic payment would be on record.

1) Vodafone have never taken over Carphone Warehouse, and there is no such thing as CW Vodafone. You purchased the phone from CW, and you were connected to Vodafone airtime.

2) When you turn off Voicemail, it does not get turned on again when roaming abroad.

3)To end up with a CCJ you must have ignored their attempts to deal with the matter. Make sure, since you paid CW, that the CCJ is marked as 'satisfied'.

4) The phone number is long gone. It can only be transferred 'ported' as part of a standard cancellation process, and cannot be passed to a different network unless it was previously 'live'. By refusing to reconnect, you lost all rights to the number. There is a possibility that you still might reclaim it as part of a reactivation, but this will probably tie you to another 12 months.

5) I cannot see how you have any possibility of getting the £300 back - it was owed to Vodafone for telephone service, and the court agreed giving you a CCJ to make payment. It wouldn't matter how you paid it, it was due, you paid the demand and the matter is concluded.

The way it was explained to me was that Carphone warehouse ran my account.

When we tried to reclaim the phone number we even considered another 12 month contract. They can't find any details of the account apart from when the Vodafone account was transferred to Carphone Warehouse.

From Carphone Warehouse the account has disappeared into the ether.

Another thought occurs that I have never been served the CCJ. I only received the letter stating that I have been served a CCJ.

I'll have to check it out again and see.

THanks for the input.

If you've never been formally served a notice to defend, a CCJ is incompetent as you must be given an opportunity to defend and put your side across. If you get a CRA file, it'll show what is registered against you.
