Default What Telewest Contract?

I am so sure that this topic has come up before but I can only appologise for repeating as I couldnt see it.

I have Telewest Broadband and Phone. I have had this since October 2006. Now that I am moving home I called to cancel and they said I have a 12 months Contract and I could only cancel if I paid the full 12 months worth.
(btw.. I am on the phone to them right now, woman coundnt handle me so went to speak to her superviser lol)

Now the dilemma...

I had recieved my welcome pack which says please sign and return the Hire Agreement.. opsss I forgot (honestly).

So what contract am I bound over by? They say Verbal Contract, so if thats the case why send me a contract to sign and return? Also the only thing I signed was the silly little slip that the workman left when installing and that doesnt say I have to be with Telewest for 12 Months.

They are now saying that it stands at what I am being told and that I will have another contract in the post to sign and return lol

So what's the deal here guys?

Any feedback on my situation is appriciated.

Do not sign anymore contract. You do not need the service anymore because you are moving house. They should have a policy for customers moving house.

However, if they still insist on a contractual agreement, then write to them requesting to have a copy of the alleged agreement they refer. Send your letter by RECORDED delivery and £1 postal order. The following note will help as part of your letter:

Dear ????????

Thank you for your letter dated 99/99/9999.

You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit). Your obligation also extends to providing a statement of telephone account. I enclose a £1 postal order in payment of the statutory fee, PO Serial Number xxxxxxxx xxxxxxxxx xxxxxxxxx.

However, if you are not able to supply the alleged agreement, take notice that I am terminating the service forthwith because I am moving house.

The CCA request doe not work with Telewest as the do not fall under the CCA because they are classified as a services company, like Vodaphone. Ask them to move the equipment to the new address and take out a new contract.

Thank you both for the useful information..

However, I dont want a new contract with telewest and I do not want them to move my account to the new address as there is already a service provider with a few more months left of contract. I told the person I am renting from that I will use till the contract exprires.
Here is the funny thing..

I spoke to a guy at telewest who is a manager and he said that telewest will pay me the money for the remainder of the contract for the exsisting service provider and will have my account conected to the new property too. it sounded weird so I asked him to put it in writing and draft a proposal to this effect.

Funny that.. Telewest wants to pay the fee for another company so I can let them move in with me lmao

Well I am looking forward to that letter.. will keep you guys posted.
