3 billing scheme

I renewed my 3 mobile contract over the phone and they told me it would be £35 per month for 18 months. 6 Months in they started charging me £61 per month!

I rang to ask them about this and they said it would be £61 from there on and the excess would be refunded at the end of the 18 months. I insisted that they just charge me the £35 per month at a flat rate rather than refund the excess as I cannot afford £61.

The guy on the phone told me he couldnt change it and I had been sent out a contract. I may have had the contract but didnt read it and its probably gone in the bin. I took what they said at face value, obviously a big mistake which I wont be making again! I didnt sign and return anything though.

Can I just write them a letter saying that I'm cancelling my contract as they have broken the verbal agreement that was made?

Well, I'll not state the obvious, you'll know better next time - however it's a strange amount for a monthly payment, (even if it is based on a cashback scheme) and it would be unreasonable of them to hold onto all the money you paid until the term is complete, THEN refund you. Staged payments would be fairer - after all, they could be taken over and 18 months is a long time in the mobile business. WRITE to them, saying you are unhappy with the arrangement that was outlined to you on the phone, and ask them to provide corroboration as you feel they are being unreasonable. If they cannot back it up, force them to agree to the original amount.
