Default 3G mobile phone problems

A friend of mine recently tried to get a morgage and discoverd that he was having problems because of a 3G mobile phone.

The phone was faulty and kept cutting out during calls and also sending out messages and calls without his notice.

he phoned up 3 to get the phone looked at and they collected it and aparently fixed it, well it was not fixed so he sent it back.
This happend several times untill eventually they replaced the phone and said the hand set had water damage which was rediculous cause the phone had never been near water.

The replacment phone was the same, same problems as the last one.
He went to a Nokia service centre and they "fixed it" but yet again the problems percisted.

Sent it back to 3 and they said that it too had been water damaged so my friend tried to claim of of his insurance.

the insurance company came back to him stating that the handset was not the original handset coverd in the insurence cover.

He then went back to 3 to get them to contact the insurence company to let them know that the phone was replaced, and 3 claimed that they had not replaced the hand set when they clearly had.

he went to the CAB they told him to sent a letter to 3 explaining the situation and asking for a new handset and for the balance to be removed or he would terminate the contract.

they replyed with a letter stating that it was his responsability to pay and that the balance of £310.22 will have to be payed.

He has payed the outstanding amount as directed by a mortgage advisor, and wants to know if he can claim back the money he payed because they messed him about so much, let him down, then expect him to pay for the privilage.

He has alot of paperwork to back his claims up

Any help would be appreciated, thanks Aphex.

Hi Aphex, I know its a while ago now , but did you have any success with this. My '3' phone is damaged and i've had it back'repaired'. Seems like i'm banging my head against a brick wall!
