Notes:
[1] The Office of Information commissioner recommended in Legal Guidance Section 5.3 that
  • "The Commissioner takes the view that, for any of these three exemptions [crime and taxation] to apply there would have to be a substantial chance rather than a mere risk that in a particular case the purposes would be noticeably damaged. The data controller needs to make a judgement as to whether or not prejudice is likely in relation to the circumstances of each individual case. …If challenged, the data controller must be prepared to defend the decision to rely upon the exemption either to the Commissioner or to the Court. It would, therefore, be advisable for the data controller to ensure that each such decision is taken at an appropriately senior level within the data controller's organisation and for the reasons to be documented."
[2] The Office of Information commissioner recommended in OIC Legal Guidance Section 4.1 on Rights of Subject Access
  • "Where a decision significantly affecting a data subject is, or is likely to be, made about that data subject by fully automated means, for the purpose of evaluating matters about that data subject such as his performance at work, his creditworthiness, his reliability or his conduct he is entitled to be told of the logic involved in the process. In order to obtain this information the data subject must specifically request it."

Would this letter be adaquate foe 3 company also? Who have mislead me on the phone about price plan etc. Also do they keep phone recordings so I can have this as prove of conversation?

Have several comments in relation to the Privacy International S.A.R - (Subject Access Request).

The networks have by now all appear to have evolved standard responses to this Subject Access Request, they will probably not disclose the RIPA based information to you and from experience will cite section 8 of the act and that the disclosure of this information will involve disproportionate effort in refusing to supply it.

As someone who does complete Subject Access Requests for my employer can I also make the following point, you probably have no idea of the scale of the information your requesting, when my current network sent me the data it was prepared to disclose it was well over a ream of A4 paper and most of it was of little to no use or relevance to me.

I'd also suggest you just ask for what you want because it will save you a long long time wading through a lot of paper looking for the info you want and it is considerably more environmentally friendly!

It's an old letter, it's been kicking around for at least five years 3 and any of the recent MVNO's wouldn't have been around when they drafted it

I was contacted by Topaz offering a mobile phone I accepted and paid first month rental of £28 as there was no credit checks. I was told the phone would be despatched in 5 working days NO PHONE I rang again and they said it would be 10 working days the 10 working days are now up and still no phone has arrived. I rang again to be told it would be checked out yet again. I have told them if I do not receive the phone in the next 48 hours then they can cancel my order and refund my money. I tried to expalin that I have now paid for 2 weeks rental and had no phone but trying to get this across I may as well knock my head against a brick wall. What is the country coming to I wonder. Has any one else used or heard of this company. The one good thing is thta I know they are based about one mile form my home therefore I can go knock on the door to get my refund.
