Angry Need help with '3' please!!

Hi,
Im new to the forum and not sure if im posting in the right place but here goes..... in 2006 i was in default to '3' for £500.00 this was passed to a collection agency called moorcroft. After paying 3 payments to them they called my house whilst i was away and told my mother they had a one time oppertunity to pay off what was left (£430) but if i paid in full i would get a discount of £107 meaning i paid £323. I paid this and havent really thought about it since. I have been looking at my credit reference report from experian and i am still in default to '3' for the orginial amount of £500!!! I have phoned '3' (waste of time) and wrote to them and spoke to Moorcroft. Moorcroft who agree i have paid the settlement figure and owe nothing more have sent me a letter to co-oberrate this but '3' are still adament that i owe them the £107 (which i might add they havent tried to get back off me in the last 2 years) i am going backwards and forwards and no one seems to be listening or reading what i am sending them. Can anyone offer me any advice or help on this please????

You will always have a default for this until it becomes time barred. Paying what is owed (or a discounted compromise) settles the debt, but does NOT removed it, unless you made this a condition of settlement. This practice isn't unusual - even if you were taken to court, had judgement against you and you eventually paid, the default would still show but with 'settled' next to it, proving you had cleared the debt.

Unfortunately, this doesn't "wipe the slate clean" as you discovered.

My experian report currently doesnt say settled on it and i doubt it will until i pay this £107. I really dont want to pay it because of the principle but other than that its the only unsettled or defaulted debt on my report. If i offer to pay the £107 to '3' could i then make it condition that they take it off default or should i just let time run its course?

Yes and no - the time to agree the removal of the default flag is BEFORE not after you have paid it. (For obvious reasons). Put forward your argument, state that you have no problem in remitting the balance they say is owed, but you have no intention having their blight on your credit file. In recognition of your full payment, you require confirmation that the default will be removed within 21 days of payment.

Get this in writing. The inference being that if they don't agree, you don't pay. (On the basis they cannot do anything else to worsen your records by not paying). Having it marked 'satisfied' is not good enough.
